Though a relatively "new" field, indigenous jurisprudence is the product of the oldest continuous legal system in the world. Utilising a range of texts – films, novels, poetry, as well as "law stories" CF Black blends legality and narrative in order to redefine jurisprudentia in indigenous terms. This re-definition gives shape to the jurisprudential framework of the book: a shape that is not just abstract, but physical and metaphysical; a shape that is circular and concentric at the same time. The outer circle is the cosmology, so that the human never forgets that they are inside a universe – a universe that has a law. This law is found in the second circle which, whilst resembling the ancient Greek law of physis is a law based on relationship. This is a relationship that orders the placing of the individual in the innermost circle, and which structures their rights and responsibilities into the land. At the root lies the divine command stating that the Land of Israel belongs to God and therefore should not be traded in perpetuity (Leviticus 25). This principle has been applied to almost all of the State lands, and was established in a Basic Law. Since the 1980s there were many pressures in Israel to privatize at least part of the State’s and JNF’s lands, due to the general privatization process of Israel’s economy, the deepening globalization process, and the transformation of Israel to an individualistic society. However, only a small portion of the lands were privatized, constituting 4% of the area of Israel. The book is based wholly on primary sources. It describes and analyzes the history of the ideological, social and legal processes that took place and their development since the beginning of the 20th century until today – processes that brought about the unique phenomenon of the State of Israel as an advanced capitalistic state whose lands are mostly state-owned.

While land and property problems exist in any society, they can be particularly exacerbated in conflict-affected settings – characterized by unstable security, weak governance, loss of proper documentation as well as the return of refugees and Internally Displaced Persons. Unless these problems are properly addressed, they can destabilize fragile political order and hinder economic recovery. Although tackling land and property problems is an important challenge for peace-building, it has been relatively neglected in recent debates about liberal peace-building as a result of the strong focus on state-level institution building, such as security sector reforms and transitional justice. Using rich original data from eight conflict-affected countries, this book examines the topic from the viewpoint of State-society relationship. In contrast to previous literature, this volume analyses land and property problems in conflict-afflicted areas from a long-term perspective of state-building and economic development, rather than concentrating only on the immediate aftermath of the conflict. The long-term perspective enables not only an understanding of the root causes of the property problems in conflict-affected countries, but also elaboration of effective policy measures for peace. Contributors are area specialists and the eight case study countries have been carefully selected for comparative study. The collection applies a common framework to a diverse group of countries – South Sudan, Uganda, Rwanda, Burundi, Cambodia, Timor-Leste, Colombia, and Bosnia-Herzegovina.
