Drawing upon extensive original research, including over 200 interviews with key actors across the EU and its trading partners, it considers the effectiveness of the trade-labour linkage in an era of global value chains. The EU believes trade can work for all, claiming that labour provisions in its free trade agreements ensure that economic growth and high labour standards go hand-in-hand. Yet whether these actually make a difference to workers is strongly contested. This book explains why labour provisions have been profoundly limited in the EU’s agreements with the CARIFORUM group, South Korea and Moldova. It also shows how the provisions were mismatched with the most pressing workplace concerns in the key export industries of sugar, automobiles and clothing, and how these concerns were exacerbated by the agreements’ commercial provisions. This pioneering approach to studying the trade-labour linkage provides insights into key debates on the role of civil society in trade governance, the relationship between public and private labour regulation, and the progressive possibilities for trade policy in the twenty-first century. Book excerpt: This book examines the labour standards provisions in a number of Regional and Bilateral Trade Agreements, and assesses the potential of using the relevant clauses in these trade agreements as a benchmark for a multilateral approach. Based on the lessons learned from the Regional model, the book proposes a Global Labour and Trade Framework Agreement (GLTFA) combined with a joint ILO/WTO enforcement mechanism to resolve the contentious issue of the link between the CLS and international trade. The history of the linkage between the Core Labour Standards (CLS) and international trade dates back roughly 150 years, and has recently become one of the most vexing issues facing policy-makers. At the heart of the debate is the question whether or not trade sanctions should be imposed on countries that do not respect the CLS as embodied in multilateral conventions administered by the International Labour Organization (ILO). Concretely, this would entail inserting a social clause in the World Trade Organization (WTO) rules, and would trigger the imposition of sanctions on those countries that do not adhere to the CLS.

The result of the committee's work is in two partsâ€"this report and a database structure. Together, they offer a first step toward the goal of providing an empirical foundation to monitor compliance with core labor standards. The report provides a comprehensive review of extant data sources, with emphasis on their relevance to defined labor standards, their utility to decision makers in charge of assessing or monitoring compliance, and the cautions necessary to understand and use the quantitative information.

Book excerpt: Mega-regional agreements have recently stirred controversy, producing a clash between the founding principles of liberalisation and protectionism, giving rise to competence issues between the European Union and its Member States. Although scholarly work has focused for years on the controversial “social clause”, it is now worth carrying out a detailed, legal analysis of the labour standards contained in the mega-regional trade agreements adopted and negotiated by the EU and the US. The topic gives rise to much controversy, as it is influenced by political convictions and election results. For this reason, it poses one of the most significant challenges to international labour law. Based on these considerations, this book examines the social dimension of three of the most relevant mega-regional trade agreements, namely TTP, CETA, and TTIP. It is argued that trade liberalisation should be accompanied by progress in the social and labour field.

Book excerpt: In the 1980s and 1990s organized labour in industrialized countries was hit by the demise of traditional manufacturing industries, the ever-expanding globalization of the economy and the ideological dominance of economic liberalism and free trade. Support for the introduction of labour standards in the world trade regime grew out of these conditions. This paper introduces an analytical framework for the study of labour standards in international trade agreements (LSITA) and provides a detailed examination of the individuals and organizations involved in the debate and an analysis of their arguments and activities. Experiences of LSITA fall into four categories: (i) unilateral: child and prison labour legislation and corporate codes of conduct; (ii) bilateral: the GSP programmes; (iii) multilateral: attempts in the GATT/WTO; and (iv) regional: the Social Charter of the EU and the labour side agreement of NAFTA.In the opposition group are neoclassical economists and free trade theorists; major international employers; and some Third World governments and economic elites.Among the proponents belong neo-Keynesians and neo-institutionalists; 'ethical' international employers; trade unions; the ILO; governments and politicians in industrialized countries; and a plethora of NGOs and individual activists.

A critical distinction is made between standards related to fundamental human rights and those related to employment conditions. The main conclusion is that trade sanctions to enforce labor standards should not be an option, but that international agreements on core labor standards, with voluntary compliance, may, apart from being worthwhile on ethical grounds, defuse calls for protection.

Book excerpt: The European Union has approximately 50 bilateral trade agreements in place with partners across the world, and more than 20 more that are at various stages of the negotiating process. These trading arrangements comprise an ever-increasing amount of the EU's trade with partner countries - over half its total external trade. At the same time, the EU has also embraced a more ambitious kind of agreement which has moved far beyond the reduction of tariff barriers and has involved the inclusion of a wider range of regulatory measures. In its recent trade agreements, the EU has included a 'Trade and Sustainable Development' chapter, which has, among other things, contained obligations in relation to labour standards. These labour standards provisions follow a common model (with limited variations) and adopt an approach which has been described as 'promotional' rather than 'conditional'. This paper examines the progressive possibilities and potential limitations of the EU's new provisions on labour standards, in the context of the broader debate about the purpose and efficacy of labour and trade linkage. The review also highlights the limited empirical research on the impact of labour standards 'on the ground' in different countries with respect to different types of agreements, and why this is problematic. The paper then makes proposals for a research agenda that can fill this gap, involving fieldwork in countries now subject to this new breed of EU bilateralism, thus exploring externalisation from the outside-in.

To examine the operationalization of this framework, we draw upon 121 interviews undertaken with key informants in three FTAs signed with the Caribbean, South Korea and Moldova. We engage with wider debates over external governance and the projection of EU power by showing how operational failings, including a lack of legal and political prioritization of TSD chapters and shortcomings in the implementation of key provisions, have hindered the impact of the FTAs upon labour standards. We also identify significant limitations to the EU's 'common formulation' approach when applied to different trading partner contexts, alongside ambiguities about the underlying purpose of the trade-labour linkage. Reflection about the function and purpose of labour standards provisions in EU trade policy is therefore required.

Book excerpt: Unlike the movement of capital, the movement of labor across countries remains highly restricted—despite the huge global returns to international labor mobility. If the benefits of temporary labor mobility are so great, why is there not more movement? Progress appears to have been stymied not by the forum of negotiations but by the political sensitivity associated with even temporary labor mobility. To circumvent this problem, the use of bilateral labor agreements, which are generally not part of trade agreements, has been proposed as an alternative means of increasing temporary labor mobility. This book analyses the viability and performance of these agreements as a complement to other efforts to liberalize the temporary movement of people. It is based on the experiences of sending and receiving countries in Europe, North America, the Caribbean, and the Pacific. Although bilateral labor agreements are not designed to promote services exports by the sending country, they can be used to do so. Countries can design flexible strategies that combine both international trade and bilateral labor agreements. Trade agreements can provide rules and disciplines that grant market access for a wide range of activities. In contrast, bilateral labor agreements can allow countries, especially developing countries, to focus on the temporary movement of very specific categories of workers, such as computer programmers or electricians within the construction sector. The experiences of some Caribbean countries, the Pacific Islands countries, and the Philippines illustrate the importance of shared responsibility—at the design, implementation, and institutional levels. At the design level, sending and receiving countries need to agree on a set of objectives and align the design to meet them. At the implementation level, joint and cooperative management involving state and nonstate actors on both sides is required. At the institution-building level, needs must be jointly diagnosed, capacity constraints addressed, and, if possible, progress monitored and evaluated. Bilateral labor agreements can be an attractive option for middle-income countries whose migratory flows are relatively small and do not generate fears in receiving countries. Source country governments should make credible commitments to ensure the temporary nature of these flows. In conjunction with the private sector, they should establish mechanisms for selecting the sectors to promote in target markets.
