Traditionally, trade agreements in the Americas were concerned with economic questions and paid little attention to human rights. However, in the wake of the 'new regionalism', which emerged at the end of the last century, more clauses addressing social issues such as labour rights and environmental standards were inserted in trade agreements. As economic integration increased, a framework for the protection of human rights evolved. This book argues that this framework allows for human rights protection on a transnational level, while constructing regional identities. Looking at the four key regional integration processes, namely the Caribbean Community, the Central American Integration System, the Andean Community of Nations and the Southern Common Market, and also at the North American Free Trade Agreement, it shows how the integration process has reached a considerable degree of consolidation. The share of intraregional trade is less than 5 percent of their total trade, substantially lower than in all other regional trading blocs around the world. Geopolitical considerations and restrictive economic policies have stifled regional integration. Economic policies have been guided by country-level considerations, with little attention to the region, and are not coordinated. Restrictions on trade and capital flows remain substantial and constrain regional integration for the private sector.

Pressures for international harmonization of labor standards arise in the context of increased trade between countries with large disparities in wages, and also reflect the history of labor standards. A critical distinction is made between standards related to fundamental human rights and those related to employment conditions. The main conclusion is that trade sanctions to enforce labor standards should not be an option, but that international agreements on core labor standards, with voluntary compliance, may, apart from being worthwhile on ethical grounds, defuse calls for protection.

The paper moves from an analysis of recent trends in regional labour mobility through an examination of the connections between trade, migration and development. Finally it considers how migration could be better governed at the multilateral, regional and bilateral levels. A central theme of the paper is that, when properly governed, labour mobility can deliver large and sustained development gains. Improving cross-border labour market access, particularly for people from developing countries, therefore needs higher prioritization by regional policymakers. At the same time, the concerns of receiving country populations around higher levels of immigration also need to be addressed. Striking this balance will require, in particular, the expansion and further adoption of co-operative agreements between sending and receiving countries which provide labour market access in return for more cooperation in migration management and enforcement.
