Book Fundamental Liberties of a Free People

Download or read book Fundamental Liberties of a Free People written by Milton Konvitz and published by Routledge. This book was released on 2018-01-16 with total page 555 pages. Available in PDF, EPUB and Kindle. Book excerpt: Of the American Bill of Rights, perhaps the forty-five words that comprise the First Amendment-allowing freedom of religion, speech, press, and assembly, and the guaranty of the writ of habeas corpus-are the most precious. Only a legal expert could lay claim to truly understanding the meaning and intention of those basic freedoms. Yet it is precisely the expert, knowing the complexity of the subject, who would be the first to hesitate to claim to possess such a thorough understanding. In analyzing such freedoms basic to American society, Milton Konvitz helps make comprehending our fundamental liberties easier. The book is divided into three parts: I. Freedom of Religion; II. Freedom of Speech, Press, and Assembly; III. Freedom of Speech, Press, and Assembly: The Clear and Present Danger Doctrine. The reader will find included such topics as the debate over the scope of the separation of Church and State, whether or not freedom of religion is an absolute right, religious freedom prior to 1776, the liberty of private schools, heresy, the right for a religious group to seek converts, the freedoms not to speak and listen, obscene literature, picketing in labor disputes, the freedom to think and believe, abridgments of speech and press, and loyalty oaths and guilt by association. Konvitz's work includes an important chapter on the history of the adoption of the Bill of Rights. His careful tracing of the development of constitutional attitudes to the freedoms protected by the First Amendment is a scholarly benchmark, and is still an archetype for students doing research and writing about these issues. It is of critical importance to anyone seeking an authoritative statement on the basic liberties guaranteed by the First Amendment to the United States Constitution.Fundamental Liberties of a Free People is a relevant and practical guide to understanding the liberties so fundamental to a free society. In his new introduction and afterword, author Milton Konvitz brings First Amendment developments up to 2002. It will be welcomed by students and scholars of constitutional law, government, politics, religion, and American history.

Book Speechless Volume 1 of 2 EasyRead Super Large 24pt Edition

Download or read book Speechless Volume 1 of 2 EasyRead Super Large 24pt Edition written by Bruce Barry and published by ReadHowYouWant.com. This book was released on 2007 with total page 586 pages. Available in PDF, EPUB and Kindle. Book excerpt: A factory worker is fired because her boss disagrees with her political bumper sticker. A stockbroker feels pressure to resign from an employer who disapproves of his off-hours political advocacy. A flight attendant is grounded because her airline doesn't like what she's writing in her personal blog. Is it legal to fire people for speech that makes employers uncomfortable, even if the content has little or nothing to do with their job or workplace? For most American workers, the alarming answer is yes. Speechless takes on the state of free expression in the American workplace, exploring its history, explaining how and why Americans have come to take freedom of speech for granted, and demonstrating how employers can legally punish employees for speaking their minds. Bruce Barry shows how constitutional law erects formidable barriers to free speech in workplaces, while employment law gives employers wide latitude to suppress speech with impunity--even speech that is unrelated to the job or the company. Employers, with rights of property ownership over not just what they manage but how they manage, can decide just how much employee speech they will tolerate. Workers have little choice but to accept conditions of employment or go elsewhere. Barry argues that a toxic combination of law, conventional economic wisdom, and accepted managerial practice has created an American workplace in which freedom of speech--that most crucial of civil liberties in a healthy democracy--is something you do after work, on your own time, and even then (for many), only if your employer approves. Barry proposes changes both to the law and to management practice that would expand employees' expressive rights without jeopardizing the legitimate interests of employers. In defense of freer speech in and around the workplace, Barry argues that a healthy democracy depends in part on the experience of liberty at work. Workplaces are key venues for shared experience and public discourse, so workplace speech rights matter deeply for advancing citizenship, community, and democracy in a free society.

Book How Conduct Became Speech and Speech Became Conduct

Download or read book How Conduct Became Speech and Speech Became Conduct written by Ken I. Kersch and published by . This book was released on 2006 with total page 40 pages. Available in PDF, EPUB and Kindle. Book excerpt: Standard accounts of constitutional development concerning the freedom of speech are constructed around two dynamics. The first involves cycles of expansions and contraction, tied to fears that are typically constructed as excessive (such as the dangers of enemies in wartime, or of political instability by domestic political opponents). The second involves a trajectory, despite periodic setbacks, of secular linear expansion (such as over the course of the twentieth century). This article argues that habitual recourse to these two dynamics, and to the understanding of rights as quot;trumps, quot; has obscured key features of (liberal) twentieth century constitutional development concerning the freedom of speech. Chief among these is the way in which speech rights have been simultaneously expanded and contracted - creating what I call quot;rights configurationsquot; - in ways that serve not to limit state, but to enforce its substantive managerial and regulatory vision. In so doing, I argue, rights declarations work to consolidate and enforce the prevailing political regime. I demonstrate this process at work by a close study key aspects of labor law, in particular the way in which courts, in dialogue with popular discourse, social movement actors, Congress, and the National Labor Relations Board, negotiated the re-categorization of labor pickets, formerly forbidden as coercive conduct, as constitutionally protected speech, and, simultaneously, the way in which courts negotiated the re-categorization of ostensibly quot;pure speechquot; by employers concerning labor unions, in certain contexts, as a form of unprotected conduct. In engaging in this process of simultaneous expansion and contraction through re-categorization, courts, in conjunction with other regime actors, worked to consolidate and legitimate the regime. In so doing, and not incidentally, they provided alternative conceptual models concerning the freedom of speech. The influence of these models, I contend, was felt beyond its initial context, and helped to inform thinking concerning the constitutionality of racial and sexual harassment statues, campaign finance regulation, and broader liberal theories concerning the nature of political deliberation and its relationship to constitutionally protected speech.

Book The Workplace Constitution

Download or read book The Workplace Constitution written by Sophia Zoila Lee and published by . This book was released on 2014 with total page 401 pages. Available in PDF, EPUB and Kindle. Book excerpt: Today, most Americans lack constitutional rights on the job. Instead of enjoying free speech or privacy, they can be fired for almost any reason or no reason at all. This book uses history to explain why. It takes readers back to the 1930s and 1940s when advocates across the political spectrum - labor leaders, civil rights advocates and conservatives opposed to government regulation - set out to enshrine constitutional rights in the workplace. The book tells their interlocking stories of fighting for constitutional protections for American workers, recovers their surprising successes, explains their ultimate failure, and helps readers assess this outcome.

Book excerpt: "The United States Code is the official codification of the general and permanent laws of the United States of America. The Code was first published in 1926, and a new edition of the code has been published every six years since 1934. The 2012 edition of the Code incorporates laws enacted through the One Hundred Twelfth Congress, Second Session, the last of which was signed by the President on January 15, 2013. It does not include laws of the One Hundred Thirteenth Congress, First Session, enacted between January 2, 2013, the date it convened, and January 15, 2013. By statutory authority this edition may be cited "U.S.C. 2012 ed." As adopted in 1926, the Code established prima facie the general and permanent laws of the United States. The underlying statutes reprinted in the Code remained in effect and controlled over the Code in case of any discrepancy. In 1947, Congress began enacting individual titles of the Code into positive law. When a title is enacted into positive law, the underlying statutes are repealed and the title then becomes legal evidence of the law. Currently, 26 of the 51 titles in the Code have been so enacted. These are identified in the table of titles near the beginning of each volume. The Law Revision Counsel of the House of Representatives continues to prepare legislation pursuant to 2 U.S.C. 285b to enact the remainder of the Code, on a title-by-title basis, into positive law. The 2012 edition of the Code was prepared and published under the supervision of Ralph V. Seep, Law Revision Counsel. Grateful acknowledgment is made of the contributions by all who helped in this work, particularly the staffs of the Office of the Law Revision Counsel and the Government Printing Office"--Preface.
