Book excerpt: En el marco del derecho de autor tienen cabida una serie de prerrogativas, de naturaleza moral y patrimonial, que pueden verse afectadas por comportamientos de distinta índole. Las nuevas tecnologías de la comunicación y de la información han facilitado enormemente el acceso y difusión de las obras, pero al propio tiempo han incrementado exponencialmente las modalidades de vulneración de los derechos existentes respecto de las mismas. Tales infracciones pueden tener consecuencias diversas dependiendo de lo estipulado en cada ordenamiento jurídico. En términos generales, en los sistemas de tradición jurídica latina tanto los derechos de naturaleza personal como patrimonial del autor se encuentran amparados en el ámbito civil, no obstante, ello varía sensiblemente cuando se pasa al ámbito penal. Lo anterior justificó que en esta investigación, a partir de la precisión de aspectos básicos relativos al derecho de autor como lo son su regulación, naturaleza y contenido, se centrara la atención en su vertiente moral, a fin de valorar las opciones político-criminales que en las legislaciones internas de los países iberoamericanos se han adoptado en la criminalización de conductas infractoras de las prerrogativas de índole personal. Para ello, una vez fundamentada la procedencia de la vía penal para la sanción de las agresiones dolosas más graves a los derechos de divulgación, paternidad e integridad de la obra, se identificaron dentro de las legislaciones de los veintidós países objeto de estudio las disposiciones penales tipificantes de delitos relativos al derecho de autor, de cuyo marco se extrajeron y consideraron las directamente relacionadas con las facultades morales. Dicho estudio evidenció que las diferentes visiones respecto a cómo se concibe el derecho de autor, el peso específico que se le acuerda en su contexto a los derechos de naturaleza personal y patrimonial, el enfoque esencialmente económico en su valoración, así como la no inclusión de los derechos morales en normativas armonizadoras que demandan estándares mínimos de protección penal; ha derivado en una regulación y consecuente tutela penal de las facultades morales de autor absolutamente disímil e incongruente en el derecho comparado, que en la mayoría de los casos lejos está de brindar una adecuada protección punitiva.

Here Michael Albert and Robin Hahnel support the libertarian socialist tradition by presenting a rigorous, well-defined model of how producers and consumers could democratically plan their interconnected activities. After explaining why hierarchical production, inegalitarian consumption, central planning, and market allocations are incompatible with "classlessness," the authors present an alternative model of democratic workers' and consumers' councils operating in a decentralized, social planning procedure. They show how egalitarian consumption and job complexes in which all engage in conceptual as well as executionary labor can be efficient. They demonstrate the ability of their planning procedure to yield equitable and efficient outcomes even in the context of externalities and public goods and its power to stimulate rather than subvert participatory impulses. Also included is a discussion of information management and how simulation experiments can substantiate the feasibility of their model.
