Book excerpt: Le principal objectif de l'étude consiste à démontrer, en temps de crise économique mondiale, comme il serait possible de conjuguer exigences de croissance économique et stratégies de protection et de valorisation du patrimoine, dans une perspective durable, en considérant que le tourisme représente un dès possible secteur pour le développement territorial, l'intégration sociale et l'amélioration des conditions de vie des collectivités locales. La région Campanie et la province de Caserte - territoires objets d'étude en Italie - sont dotés d'un exceptionnel patrimoine culturel, paysager et immatériel mais ne sont pas suffisamment protégés et valorisés. À cette fin, la recherche analyse et propose des stratégies de gestion des biens à travers l'étude des best practices françaises dans le domaine du tourisme culturel, considérées comme le moteur de développement durable du territoire. La France, classée premier pays au monde pour le nombre de visiteur international, selon les statistiques de l'Organisation mondiale du tourisme, a développé une politique gouvernementale de long terme visant à la protection et à la promotion du patrimoine, grâce à des interventions sur les biens, sur la structure organisationnelle des institutions responsables, et sur toutes les formes d'art de la production intellectuelle. En Italie, en revanche, la stratégie de gestion s'est souvent montrée inadéquat par rapport au prestige international dont elle dispose sur le plan de son patrimoine culturel, paysager, gastronomique et immatériel. Un management contestable des biens, a donné lieu à une croissance limitée de l'économie par rapport à son potentiel avec un effet négatif sur le patrimoine.

La mise en tourisme d'un espace, en utilisant les justes politiques de développement, vise à tirer parti de ses potentialités environnementales, patrimoniales et culturelles, tout en favorisant son économie. Ce constat est démontré dans ce mémoire à travers une analyse de la situation de l'Italie méridionale, qui se trouve aujourd'hui dans des conditions de sous-développement économique par rapport au reste du pays. Pour représenter cette réalité, l'étude s'appuie ainsi sur le cas d'un territoire en particulier, se situant en Campanie, au sud de Naples: la Côte du Vésuve. Ce dernier présente d'énormes potentialités touristiques grâce à son patrimoine artistique, ses beautés paysagères, son histoire, sa richesse culturelle et sa gastronomie, mais il n'arrive pas à se développer touristiquement. La première partie s'appuie sur un diagnostic territorial de la Côte du Vésuve, composée de sept villes, afin de présenter au lecteur ses atouts et ses faiblesses. Successivement, un deuxième chapitre vise à analyser les freins qui existent dans le territoire et qui en empèchent le développement, comme l'influence du contexte historique et économique, l'insuffisance d'investissements publics et privés, la mauvaise gestion des biens culturels publics et le manque d'infrastructures et aménagements destinés à accueillir les visiteurs. Une troisième partie a pour but d'approfondir l'imaginaire que les touristes étrangers ont du Sud de l'Italie et de la province de Naples, qui est souvent très stéréotypé dans le bon et le mauvais sens.

Book excerpt: Selon une étude conduite par l'UNESCO, l'Italie possède 45% du patrimoine artistique mondial. Malheureusement elle occupe aussi la première place dans le trafic illégal d'oeuvres d'art. En 1994, le Censis parlait d'un trafic clandestin pour une valeur de 1000 milliards de lires. Il semble donc évident que le trafic illégal des biens culturels constitue, aujourd'hui, un important problème économique et social. Cette thèse a pour objet l'analyse de la situation juridique des oeuvres d'art en Italie. L'état de la protection juridique mise en place tant au niveau national que communautaire et international apparaît lacunaire. En Italie le Code pénal et le Code de procédure pénale ne prévoient pas de sanctions adéquates en matière de protection des biens culturels, c'est pourquoi la dissuasion et la prévention sont très rarement réalisées. La Mafia n'a pas tardé à s'intéresser à un marché aussi riche et rentable que celui des oeuvres d'art, cela entraînant un renforcement des liens entre criminalité organisée et trafic illégal d'oeuvres d'art. L'ouverture des frontières communautaires a sensiblement facilité l'exportation illégale d'oeuvres d'art. Il est urgent de trouver une solution législative et institutionnelle permettant de contrer le développement de ce trafic illégal, d'autant plus que, pendant ces dernières années, beaucoup d'oeuvres d'art ont été retrouvées mais, faute d'une législation nationale et internationale cohérente, elles n'ont jamais été rapatriées. L'opinion publique italienne est de plus en plus touchée par le trafic illégal d'oeuvres l'art et par l'appauvrissement du territoire national. C'est pourquoi on a récemment assisté au développement d'un processus de `valorisation' des biens culturels. Le Parlement, les Régions, les Communes et nombreuses Associations culturelles et Fondations ont ouvert la route des réformes.
