Or, défini comme le principe fondateur d'un ordre juridique privé, il s'impose, au contraire, comme l'instigateur de la juridicité dans l'entreprise. Le phénomène du pluralisme juridique est, dès lors, mobilisé pour analyser les fonctions de l'intérêt de l'entreprise. Celles-ci sont doubles. L'intérêt de l'entreprise apparaît, en premier lieu, comme un instrument de production de la norme. La reconnaissance de cette fonction normative ne pouvait, dès lors, que perturber l'ordonnancement traditionnel des sources en droit du travail. Les transformations qui en découlent mettent en exergue l'émergence d'une nouvelle forme d'ordre public. De surcroît, les valeurs promues par l'ordre juridique d'entreprise, dont l'intérêt de l'entreprise est porteur, interrogent les fondements même de l'ordre étatique et soulève le problème de leur compatibilité. Au-delà, se pose la question des rapports entre l'intérêt de l'entreprise et l'intérêt général. En second lieu, l'intérêt de l'entreprise se présente comme un mécanisme de résolution des conflits d'intérêts au sein de l'entreprise. Cette fonction régulatrice se manifeste à travers plusieurs mécanismes tels que l'abus de droit et le détournement de pouvoir mais ne s'épanouit véritablement qu'à travers le contrôle de proportionnalité. Progressivement, l'intérêt de l'entreprise met en place des processus de coopération internes à l'entreprise aboutissant à une véritable autorégulation de celle-ci. L'essor des chartes éthiques et des codes de bonne conduite atteste d'une telle évolution.
