Book excerpt: La presente monografia affronta il delicato tema della tutela della salute del lavoratore nel quadro della legislazione nazionale e comunitaria, con specifico approfondimento sui nuovi rischi (straining, burn-out, mobbing) esistenti nell’ambito del rapporto di lavoro, così come emergono sia alla luce dell’evoluzione giurisprudenziale che dei modelli organizzativi che vanno affermandosi per effetto dei mutamenti normativi e delle trasformazioni imposte, in particolare, dal Jobs Act.La trattazione è strutturata in tre parti: nella prima, relativa a Diritti della persona, responsabilità dell’impresa e organizzazione del lavoro dopo il c.d. Jobs Act, l’A., dopo aver approfondito il sistema normativo italiano ed europeo di protezione sociale, affronta le implicazioni sulla sicurezza dei lavoratori, dopo un decennio di esperienza applicativa del d.lgs. n. 81/2008, delle misure di flessibilità introdotte nell’ordinamento dai recenti provvedimenti, anche in una prospettiva comparata con altri ordinamenti europei; nella seconda, Organizzazione del lavoro, norme tecniche e tutela del lavoratore in azienda, esamina l’impatto e la portata delle norme tecniche sui modelli organizzativi d’impresa; infine, nella terza e ultima parte, Misure di controllo e sistema sanzionatorio della sicurezza sul lavoro nelle riforme del Jobs Act, affronta i profili di riforma dei servizi ispettivi nell’ambito del regime dei controlli, alla luce delle innovazioni anche in tale campo introdotte dal Jobs Act.

But some changes provoke more attention than others, in part due to the vast uncertainty involved in making predictions about the future. The 2019 World Development Report will study how the nature of work is changing as a result of advances in technology today. Technological progress disrupts existing systems. A new social contract is needed to smooth the transition and guard against rising inequality. Significant investments in human capital throughout a person’s lifecycle are vital to this effort. If workers are to stay competitive against machines they need to train or retool existing skills. A social protection system that includes a minimum basic level of protection for workers and citizens can complement new forms of employment. Improved private sector policies to encourage startup activity and competition can help countries compete in the digital age. Governments also need to ensure that firms pay their fair share of taxes, in part to fund this new social contract. The 2019 World Development Report presents an analysis of these issues based upon the available evidence.
