Book excerpt: Derived from the renowned multi-volume International Encyclopaedia of Laws, this book provides ready access to legislation and practice concerning the environment in Italy. A general introduction covers geographic considerations, political, social and cultural aspects of environmental study, the sources and principles of environmental law, environmental legislation, and the role of public authorities. The main body of the book deals first with laws aimed directly at protecting the environment from pollution in specific areas such as air, water, waste, soil, noise, and radiation. Then, a section on nature and conservation management covers protection of natural and cultural resources such as monuments, landscapes, parks and reserves, wildlife, agriculture, forests, fish, subsoil, and minerals. Further treatment includes the application of zoning and land-use planning, rules on liability, and administrative and judicial remedies to environmental issues. There is also an analysis of the impact of international and regional legislation and treaties on environmental regulation. Its succinct yet scholarly nature, as well as the practical quality of the information it provides, make this book a valuable resource for environmental lawyers handling cases affecting Italy. Academics and researchers, as well as business investors and the various international organizations in the field, will welcome this very useful guide, and will appreciate its value in the study of comparative environmental law and policy.

Book Human Rights and Emerging Technologies

Download or read book Human Rights and Emerging Technologies written by Daniele Ruggiu and published by CRC Press. This book was released on 2018-06-26 with total page 311 pages. Available in PDF, EPUB and Kindle. Book excerpt: What is the state of current European governance on new and emerging technologies, and where is it going? What is, and what can be, the role of human rights in governance arrangements? These are the main questions that this book answers for both European and non-European scholars. It provides a wide picture of current European governance, notably in biotechnology, nanotechnology and synthetic biology, and discusses the model of Responsible Research and Innovation, which is gaining popularity within the European Union, under a human rights perspective. It shows how human rights can contribute to governance frameworks without posing obstacles to research and innovation. The theory presented in the book is followed by practical guidelines drawn from human rights law. Starting from the Strasbourg Court jurisprudence, it provides a complete review of the wide range of rights that the European Convention on Human Rights protects in light of the challenges of techno-scientific advances. This analysis will come in handy for private actors, policymakers, regulators, as well as judges in solving hard cases raised by techno-scientific progress in the future.

Book Children s Environmental Rights Under International and EU Law

Download or read book Children s Environmental Rights Under International and EU Law written by Francesca Ippolito and published by Springer Nature. This book was released on 2022-11-07 with total page 346 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book is dedicated to a topic which has for a long time lacked the attention it deserves within the academic world. It intends to address in a coherent and comprehensive manner the problem of the environmental rights of the child, which are not identical to the ones of adults whose environmental rights have been appraised from a general point of view. In the absence of any international law instrument explicitly granting a child the right to a clean environment, drawing on an extensive and original analysis of the UN Convention on the Rights of the Child and the practice of its monitoring body, this book undertakes an assessment of the extent to which these challenges may be overcome through a greater engagement between international law on the rights of the child and international environmental law. The result is the first comprehensive study on the manner in which these two mutually reinforcing legal regimes can interact to strengthen the protection of children’s environmental human rights at stake in the increased strategic environmental and climate litigations at both the national and international level. The book is recommended reading for, amongst others, policy makers, international environmental lawyers and human rights lawyers and practitioners. Additionally, lecturers, students and researchers from a range of disciplines will also gain from seeing how new legal scholarship and intertwined branches of international law contribute to the continual development of the living rights of the human rights conventions. Francesca Ippolito is Associate Professor of International Law in the Department of Political and Social Science of the University of Cagliari, Italy. She holds the Jean Monnet Chair on European Climate of Change - REACT for 2021-2024.

Book Trends and Challenges in International Law

Download or read book Trends and Challenges in International Law written by Maurizio Arcari and published by Springer Nature. This book was released on 2022-04-22 with total page 327 pages. Available in PDF, EPUB and Kindle. Book excerpt: Over the last century, international law has sought to keep pace with sweeping changes that have revolutionised the international community. It has done so in various ways: by developing new fields, adopting new legal instruments, and including new actors and entities in the international fora. Human rights law and environmental law have emerged to address essential issues raised by civil society. Treaties, judgments and soft law instruments have attempted to fill the gaps in regulation. International organisations, corporations, civil society organisations and individuals have all worked to make and enforce, also by judicial means, legal rules. But is all this sufficient? In an effort to answer this question, the chapters of this volume explore selected emerging issues in the fields of human rights, the environment, cultural heritage and law of the sea. Can state responsibility help to protect the environment? Can protecting human rights be reconciled with national security? Can the UN Security Council address climate change? Is law of the sea still fit for purpose? And how can we balance human rights and the environment, or cultural heritage and law of the sea? The international scholars and experienced practitioners who have contributed to this volume discuss these and other key questions.Given its scope, the book will appeal to researchers and scholars of international law, as well as those specialising in human rights law, environmental law, cultural heritage law, and law of the sea.

Book The European Union and Sustainable Development

Download or read book The European Union and Sustainable Development written by Alessandra Mignolli and published by Edizioni Nuova Cultura. This book was released on 2018-11-15 with total page 286 pages. Available in PDF, EPUB and Kindle. Book excerpt: The European Union has the ambition to be one of the largest markets and one of the most influential trade actors in the globalized economy, but also the mission to spread the values and principles at the foundations of the European integration process: democracy, the rule of law, respect and protection of human rights and fundamental freedoms, environmental protection and sustainable development. This twofold mission is at the origin of the measures which are the object of this book. The focus of the research is the role of the Union in pursuing sustainable development and human rights in third countries through unilateral trade instruments and applying different methods of regulation. The study is conducted against the background of international law and of the WTO rules on multilateral trade. It addresses the tension between unilateralism and multilateralism in EU policies for sustainable development, with a focus on the problematic issue of the extraterritorial reach of EU measures.

Book Cultural Heritage in International Investment Law and Arbitration

Download or read book Cultural Heritage in International Investment Law and Arbitration written by Valentina Vadi and published by Cambridge University Press. This book was released on 2014-03-13 with total page 379 pages. Available in PDF, EPUB and Kindle. Book excerpt: Can states adopt protectionist cultural policies? What are the limits, if any, to state intervention in cultural matters? A wide variety of cultural policies may interfere with foreign investments, and a tension therefore exists between the cultural policies of the host state and investment treaty provisions. In some cases, foreign investors have claimed that cultural policies have negatively affected their investments, thereby amounting to a breach of the relevant investment treaty. This study maps the relevant investor-state arbitrations concerning cultural elements and shows that arbitrators have increasingly taken cultural concerns into consideration in deciding cases brought before them, eventually contributing to the coalescence of general principles of law demanding the protection of cultural heritage.

Download or read book International Human Rights Law written by Riccardo Pisillo Mazzeschi and published by Springer Nature. This book was released on 2021-09-29 with total page 557 pages. Available in PDF, EPUB and Kindle. Book excerpt: This textbook provides a thorough and systematic overview of human rights law, including the most relevant practice and case law, but also dealing with theoretical issues. It pursues an original approach, seeking to reconcile its didactic purpose with a scientific one, positing that there must be a necessary synergy between these two purposes. Furthermore, the author is convinced that international human rights law should not be studied (as is done in virtually every textbook) as a special legal regime, separate and autonomous from the overall system of international law; but as a regime that is fully integrated into the international legal order. The book’s dominant theme is the interrelationship of international human rights law and general international law. Following this approach, the author has chosen to devote comparatively little content to institutional issues (Part IV) and to instead more intensively explore the structural impact of human rights law on the entire international order (Part I); on the sources (Part II) and obligations (Part III) of general international law; and what constitutes “fundamental” human rights (Part V), without neglecting other rights (Part VI).
