Book excerpt: La recente scelta operata dal legislatore con il d.lgs. n. 149 del 2022, attuativo della legge delega n. 206 del 2021, di estendere la negoziazione assistita dagli avvocati anche alle controversie di lavoro, può da un lato costituire un ulteriore elemento di valorizzazione dell’autonomia individuale, dall’altro far perdere la dimensione collettiva che storicamente è garanzia di parità contrattuale. A questo si accompagna la scelta del legislatore degli anni Duemila di dirigere la domanda di giustizia dalla giurisdizione statale alla regolazione privata, sia disincentivando l’accesso alla prima, che fornendo alla seconda elementi di agevolazione e celerità, per cui occorre interrogarsi sul grado di effettività della tutela dei diritti del lavoratore nel nuovo assetto giuridico caratterizzato dall’abbattimento dei livelli di protezione del lavoro e di compressione degli spazi di tutela giudiziale. Se la Carta costituzionale, prendendo atto della contrapposizione tra capitale e lavoro, incarica la Repubblica di correggere lo squilibrio di poteri e di opportunità tra le parti attraverso meccanismi redistributivi e di implementazione dell’uguaglianza sostanziale, l’accesso a forme alternative di risoluzione delle controversie, pur nell’ambito di una complessiva asistematicità e a tratti incoerenza della disciplina, potrebbe costituire una ulteriore via di implementazione dell’effettività dei diritti dei lavoratori, a condizione che siano garantiti gli stessi diritti sostanziali e processuali che si hanno nella giurisdizione statale. Per altro verso, una disciplina in materia di conciliazione e arbitrato ispirata ai canoni della chiarezza sistematica e della semplicità tecnica, nonché corredata da disposizioni finanche migliorative della tutela dei diritti del lavoratore, appare la condicio sine qua non per rendere tali strumenti all’altezza del compito affidato. In questo contesto, i principi fondamentali delineati dalla Costituzione repubblicana dovranno costituire la base giuridica essenziale della regolazione dei diritti sostanziali e della relativa tutela giurisdizionale e negoziale, affinché il diritto del lavoro possa continuare ad essere un effettivo baluardo di difesa solidaristica delle persone dalle logiche altrimenti disgreganti del mercato.

It has long been accepted that international organizations and their staff need to enjoy immunity from the jurisdiction of national courts. However, it is the application of these rules in practice that increasingly causes controversy. Claims against international organizations are brought before national courts by those who allegedly suffer from their activities. These can be both natural and legal persons such as companies. National courts, in particular lower courts, have often been less willing to recognize the immunity of the organization concerned than the organization’s founding fathers. Likewise, public opinion and legal writings frequently criticize international organizations for invoking their immunity and for the lack of adequate means of redress for claimants. It is against this background that an international conference was organized at Leiden University in June 2013.
