Book excerpt: Luego de la publicación de la primera edición de esta obra no solo ha entrado en vigencia el Código Penal de 2000, sino también varias leyes que han modificado y adicionado los tipos penales de los delitos contra el patrimonio económico; además, se han creado nuevas figuras patrimoniales como las de corrupción privada (art. 2soA C.P) y administración desleal (art. 2soB c.P.), las cuales ameritan su correspondiente estudio. La Ley 1273 del g de enero de 2009 adicionó el Código Penal con el Título VII Bis, denominado "De la protección de la información y de los datos", cuyo Capítulo segundo trata "De los atentados informáticos y otras infracciones" y tipifica los delitos de hurto por medios informáticos y semejantes (art. 2691 CP) y transferencia no consentida de activos (art. 269J c.P.). En esta edición me ocupo del análisis de estas figuras delictivas, porque si bien es cierto que los delitos descritos en dicho Capítulo segundo del Título VII Bis tutelan la información y los datos, también lo es que protegen además el patrimonio económico, dado que así lo dispone de manera expresa el artículo 2691 al remitir al tipo descrito en el artículo 239 del Código Penal, que contiene el tipo básico del delito de hurto. De otra parte, el delito de transferencia no consentida de activos tiene como objeto material derechos de crédito constitutivos del patrimonio económico.

Many Asian nations called upon the services of Englishman and Law Professor Sir Ivor Jennings to advise or assist their own constitution making. Although he was one of the twentieth century’s most prominent constitutional scholars, his opinion and influence were often controversial and remain so due to his advocating British norms in Asian form. This book examines the process of constitutional formation in the era of decolonisation and state building in Asia. It sheds light upon the influence and participation of Jennings in particular and British ideas in general on democracy and institutions across the Asian continent.
