Book excerpt: This book defends that the pursuit of originality constitutes one of the most important characteristics of creativity, but that originality refers, etymologically, to both origin and originary. Hence, the book is structured into two parts, dedicated, respectively, to the creative categories of origin and the creative categories of originary. Within the former are creation myths, games – the origin of all cultural activity, the dialectic chaos-order, axial civilizations – the germ of our time, and the struggle between generations – a factor of social transformation, and, within the second, creative capitalism, creative work in the context of the global economy of risk and uncertainty, and representative democracy. However, these two concepts are not isolated, but deeply interrelated, in a way that explains how creative originality builds a temporal narrative. It has been dislocated in late modernity and, with it, creativity has been broken.

Thinkers like Habermas and Apel have proposed that judgments of both fact and value become objects of public debate. The debate should determine whether these judgments can earn the assent of the community. If so, they attain a degree of intersubjective validity. Javier Muguerza's Ethics and Perplexity makes a highly original contribution to the debate over dialogical reason. The work opens with a letter that establishes a parallel between Ethics and Perplexity and Maimonides's classic Guide of the Perplexed. It concludes with an interview that repeatedly strikes sparks on Spanish philosophy's emergence from its "long quarantine," as Muguerza puts it. These informal pieces--witty, informative, conversational--orbit the nucleus of the work: a formidable critique of dialogical reason. The result is a volume by turns vivid and profound. Muguerza insists that the experience of perplexity is inseparable from the exercise of philosophy. Perplexity avoids both the certainty of dogmatism and the ignorance of skepticism. In fact, it is the only philosophical ailment capable of immunizing us against both. Public power can only be legitimately exercised if it is based on and complies with the law. The Constitution and its fundamental values – human dignity, freedom and equality – are the ultimate sources of orientation for the rule of law. Domestic rule of law is complemented by its external dimension, the duty to respect international law and, for EU member states, supranational law. For the World Jurist Association, the realization of the Rule of Law has been the central concern since its founding more than 60 years ago. Its biennial world congresses, which bring together leading figures from politics, the judiciary and academia under the presidency of Javier Cremades, focus on the universal importance of the rule of law, which experts from numerous countries discuss on the basis of current problem areas. At the 2021 World Law Congress in Barranquilla, Colombia, one central topic was the tension between combating pandemics and the rule of law. The contributions gathered here examine how this challenge was met in political-legal practice, and the role of constitutional jurisdiction in the process. They analyze and evaluate the legal situation in numerous countries in Europe and Latin America. In addition, they reflect on fundamental issues, such as the concept of the rule of law, its relationship to democracy, its universal character and its implementation via jurisprudence.

However, the very concept of civil society is deeply rooted in European traditions and values. In pursuing civil society reform in non-Western countries, many scholars along with well-meaning international agencies and donor organisations fail to account for non-Western values and historical experiences. Civil Society in the Global South seeks to redress this balance by offering diverse accounts of civil society from the global South, authored by scholars and researchers who are reflecting on their observations of civil society in their own countries. The countries studied in the volume range from across Africa, Latin America, Asia and the Middle East to give a rich account of how countries from the global south conceptualise and construct civil society. The book demonstrates how local conditions are often unsuited to the ideal type of civil society as delineated in Western values, for instance in cases where numerous political, racial and ethnic sub-groups are ‘fighting’ for autonomy. By disentangling local contexts of countries from across the global South, this book demonstrates that it is important to view civil society through the lens of local conditions, rather than viewing it as something that needs to be ‘discovered’ or ‘manufactured’ in non-Western societies. Civil Society in the Global South will be particularly useful to high-level students and scholars within development studies, sociology, anthropology, social policy, politics, international relations and human geography.
