Le cadre juridique actuel de la bancassurance est pourtant inadapté au paysage économique moderne, le législateur n'ayant pas prévu que les établissements de crédit s'immisceraient aussi activement dans l'intermédiation en assurance. Ainsi, le statut de courtier adopté par les banques est discutable, les établissements concernés opérant en réalité comme des agents généraux d'assurance. La consécration en 2002, par le législateur communautaire, d'un statut d'intermédiaire lié n'offre que des perspectives de régularisation limitées et pourrait être source de confusions. Par ailleurs, le régime de la responsabilité civile des banquiers et assureurs liés par des accords de distribution connaît des insuffisances notables au regard des exigences de la lutte contre le blanchiment des capitaux et le financement du terrorisme. Enfin, le régime des obligations d'information et de conseil du bancassureur ainsi que celui du recours aux ventes liées et ventes avec primes se révèlent complexes, difficiles à mettre en œuvre et exposent de facto les bancassureurs à une insécurité juridique permanente. Les opérateurs de bancassurance doivent donc prendre un certain nombre de précautions leur permettant de maîtriser le risque juridique et de mieux se défendre en cas de litiges. En définitive, dans un souci d'efficacité, il convient d'adapter progressivement la réglementation existante à la spécificité de la bancassurance, afin que la réalité juridique suive la réalité économique.
