The author begins by summarizing the main steps in this special and evolving relationship which has long oscillated between membership and marginalization. He also guides us expertly through the thickets of referendums (no fewer than fourteen from 1972 to the time of writing!) in which Swiss citizens have been given the opportunity to pass judgment on the European question. Finally and perhaps most importantly, this volume explains why the Swiss still oppose joining the European Union. It examines the thorny questions of identity, reservations on policy matters (preserving neutrality, direct democracy and Swiss style federalism), not to mention doubts regarding the economy, which have done so much to shape public opinion and the official strategy of the Swiss Confederation. Paradoxically, the closer Switzerland gets to the EU through bilateral agreements, the more distant prospects of joining the EU seem to become. This is the conundrum at the heart of the relationship between the Swiss Confederation and the European Union which is expertly explored in this volume.

Focusing on the problems faced by Switzerland in the field of international protection of refugees as well as on the specificity of its asylum law and practice, this publication addresses the refugee problem from a national, European and international perspective. The Swiss experience serves to illustrate the wider problematic of on the one hand, the tensions between security, political and humanitarian concerns encountered by refugee-receiving states, and on the other, the need to preserve an international refugee protection regime which remains an essential component of international law and relations for so long as political solutions are not brought to the root causes of refugee exodus. This reflection on the international protection of refugees is organized around four main themes. The first examines Switzerland's response in the past to mass influx, in the light of historical case studies and the evolution of Swiss asylum law and practice. The second focuses on the question of access of refugees to asylum territories and refugee status determination procedures within the framework of the 1951 Convention on the Status of Refugees and the current Swiss asylum law. The third centres on the wider protection regime currently being forged in Europe to address a broader category of refugees, including solutions for temporary and subsidiary protection. The final theme revolves around return of refugees, including those under the Dayton and recent Kosovo agreements and covers reintegration of returnees, assistance and long-term development. This work is based on papers presented at a colloquium of the Graduate Institute of the International Studies in Geneva which was organised in collaboration with the Office of the United Nations High Commissioner for Refugees as a contribution to the 50th anniversaries of the UNHCR and the Geneva Convention relating to the Status of Refugees.

On this basis a critical analysis is provided of the main institutional problems, the current policy framework, the overarching rationale as well as of the content and quality of the nascent EU migration law. The book is divided into three parts. The first two parts provide a comprehensive study of the institutional framework and the substantive EC/EU law respectively. The third and final part provides a more general analysis of the policy-making process. Since the major achievements in the field of migration are recent, the book focuses to a great extent on the post-Amsterdam era. However, for reasons of coherence and in order to better evaluate recent developments, a concise overview of the origins of this policy is provided. Moreover, special emphasis is placed on the Schengen acquis, since its mark on European affairs has been and remains pronounced. Overall the attempt has been to provide an account, which is up to date with extensive historical references and combines both an academic and practical perspective to the legal and political issues involved. The approach based on the above elements will contribute to a new understanding of the main aspects of EU migration law and its policy ramifications and will be of use to both academics and practitioners alike.

Book excerpt: This book conceptualizes the EU’s ambition at exercising a “joined up approach” (i.e. the mobilization of EU sectoral policies to realize EU foreign policy goals towards a third country). The framework is applied to three case studies: Switzerland and the Institutional Framework Agreement, Morocco and the Western Sahara issue, and Israel and the Israeli-Palestinian conflict. With the help of these, the author argues that the EU is more likely to follow foreign policy objectives by leveraging on sectoral cooperation ties when the foreign policy objective concerns the conditions of participation in the single market (Switzerland). He also shows that a lack of member states’ coherence concerning the compatibility of the foreign policy objective with overarching economic (Israel) or regional/geopolitical (Israel and Morocco) interests counteracts the exercise of a joined-up approach.
