Ante la dificultad de llegar a un criterio único respecto al concepto de reversión, por asociarse al señorío constante del Estado sobre la actividad concedida y al dominio público de los bienes estatales y extenderse su entendimiento y aplicación a la totalidad de categorías concesionales, se justifica un análisis independiente sobre la reversión en los contratos de concesión de servicios públicos, en general, y, en particular, en el contrato que otorga en concesión la prestación, operación, explotación, organización o gestión del servicio público domiciliario de aseo. Esta investigación tiene como propósito principal demostrar razonadamente que el alcance del contenido obligacional de la reversión, de incorporarse al contrato de concesión del servicio público de aseo, tendrá fuente en el contrato y no en la ley, será una cláusula de contenido económico y corresponderá a un elemento accidental del mismo. Con ese fin, aborda, entre otros, la caracterización del contrato de concesión y, especialmente, del contrato de concesión de servicios públicos, las particularidades del contrato de concesión del servicio público de aseo y la categorización de los bienes destinados a su prestación; examina, además, el ejercicio irregular de la prerrogativa de reversión, respecto del contrato de concesión del servicio público de aseo, como conducta administrativa equivalente al incumplimiento contractual y generadora de daño antijurídico.
