En effet, dès lors que la société fait l'objet d'une procédure collective, l'exigence d'une faute séparable des fonctions disparaît, seule la faute gestion est requise dans cette hypothèse, encore faudrait- il qu'elle ait contribué à l'insuffisance d'actif subie par les créanciers.
