Download or read book Corporate Criminal Liability and Sanctions written by Michala Meiselles and published by Taylor & Francis. This book was released on 2024-09-18 with total page 156 pages. Available in PDF, EPUB and Kindle. Book excerpt: This edited collection sheds light on the evolution of corporate financial crime, exploring a myriad of offenses ranging from money laundering and fraud to market manipulation and bribery. Considering and assessing the models used in national law to determine the culpability of corporations, this book compares the different schemes used to address financial and other organisational crimes committed by these entities. Through a combination of history, law, and global perspectives, its chapters dissect landmark cases and provide detailed analyses of money laundering, fraud, market manipulation, manslaughter, and legislative responses in various locations around the world. This comparative approach offers a unique lens, exploring diverse jurisdictions and shedding light on global patterns of corporate wrongdoing. By critically assessing the challenges of prosecuting economic crimes on a large scale, the collection proposes innovative solutions, including the introduction of ‘failure to prevent’ offences. Corporate Criminal Liability and Sanctions: Current Trends and Policy Changes is a valuable resource for academics, professionals, and anyone intrigued by the ever-evolving realm of white-collar and corporate wrongdoing. It will appeal to scholars across the fields of law, criminology, sociology, and economics, as well as those professionally engaged in preventing and investigating corruption and in developing or enforcing regulation, such as solicitors, barristers, businessmen, and public servants.
Download or read book Transformations in Criminal Jurisdiction written by Micheál Ó Floinn and published by Bloomsbury Publishing. This book was released on 2023-08-24 with total page 395 pages. Available in PDF, EPUB and Kindle. Book excerpt: Can traditional approaches to criminal jurisdiction adapt to the new global reality of the digital era? In this innovative book, leading experts in criminal, international and internet law unite to address this fundamental question. They consider how jurisdictional regimes are orientated around concepts of territoriality and extraterritoriality, how these categories are increasingly blurred in the digital era, and how a range of jurisdictional transformations are occurring in the process. Part I presents novel doctrinal, empirical and theoretical perspectives on criminal jurisdiction, exploring how states are shaping and reimagining jurisdictional concepts in the crafting and interpretation of criminal offences, and the ramifications of increasing jurisdictional concurrency in state practice. Part II focuses on the investigative and enforcement powers of the state to assess how these issues are transforming traditional understandings of jurisdictional rules and boundaries, the challenges and opportunities that these present for law enforcement authorities, and the sorts of constraints and safeguards that may be necessary as a result. The picture that emerges is a world of jurisdictional rules in a state of flux, which demands the diversity of legal perspectives presented in this book for documenting, rationalising and moving beyond the transformations that are taking shape in modern statecraft.
Download or read book Environmental Crime in Europe written by Andrew Farmer and published by Bloomsbury Publishing. This book was released on 2017-12-14 with total page 385 pages. Available in PDF, EPUB and Kindle. Book excerpt: "Environmental crime is a growing challenge for policy makers and law enforcers. This is an important and timely study which examines in depth how environmental crime is treated at national level within the European Union and the impact of the 2008 EU Directive on environmental crime on national systems. It will be required reading by anyone concerned with making environmental law more effective." Richard Macrory, Emeritus Professor, University College London The aim of this important new collection is to explore how environmental crime is controlled and environmental criminal law is shaped and implemented within the European Union and its Member States. It examines the legal framework, looking in particular at Directive 2008/99/EC, and the specific competences of the EU in this domain. In addition, it provides a detailed analysis of environmental criminal law in seven Member States, focusing inter alia on the basic legislation, the way in which environmental pollution is criminalised and the main actors in place to enforce environmental criminal law. In so doing, it provides a much needed explanation of the evolution of environmental criminal law in Europe at Union level and how this is implemented in selected Member States.

Download or read book Mark Antony written by Paolo de Ruggiero and published by Pen and Sword. This book was released on 2014-02-12 with total page 330 pages. Available in PDF, EPUB and Kindle. Book excerpt: Mark Antony was embroiled in the tumultuous events of the mid-1st century BC, which saw the violent transformation from the Roman Republic to the Roman Empire. After being defeated by Augustus he has often been characterized by hostile historians as a loyal henchman of his uncle Julius Caesar but without the guile and vision to attain greatness in his own right (hence Shakespeare casts him as a 'plain, blunt man' whom Caesar's assassins don't think it worthwhile to kill). In his infamous alliance and love affair with Cleopatra of Egypt he is also often seen as duped and manipulated by a sharper mind. Despite this there is no doubt Antony was a capable soldier. He first saw action leading a cavalry unit in Judaea, before giving valuable service to Julius Caesar in Gaul. He again served with distinction and led Caesar's right wing at the climactic battle of Pharsalus, and he was decisive in the defeat of the conspirators at Philippi which ended 100 years of Civil wars. But Paolo de Ruggiero re-assesses this pivotal figure, analyses the arguments of his many detractors, and concludes that he was much more than a simple soldier, revealing a more complex and significant man, and a decisive agent of change with a precise political vision for the Roman world.

Download or read book Quantum Computing and Quantum Bits in Mesoscopic Systems written by Anthony Leggett and published by Springer Science & Business Media. This book was released on 2012-12-06 with total page 264 pages. Available in PDF, EPUB and Kindle. Book excerpt: Quantum information science is a new field of science and technology which requires the collaboration of researchers coming from different fields of physics, mathematics, and engineering: both theoretical and applied. Quantum Computing and Quantum Bits in Mesoscopic Systems addresses fundamental aspects of quantum physics, enhancing the connection between the quantum behavior of macroscopic systems and information theory. In addition to theoretical quantum physics, the book comprehensively explores practical implementation of quantum computing and information processing devices. On the experimental side, this book reports on recent and previous observations of quantum behavior in several physical systems, coherently coupled Bose-Einstein condensates, quantum dots, superconducting quantum interference devices, Cooper pair boxes, and electron pumps in the context of the Josephson effect. In these systems, the book discusses all required steps, from fabrication through characterization to the final basic implementation for quantum computing.

Download or read book Macroscopic Quantum Coherence and Quantum Computing written by Dmitri V. Averin and published by Springer. This book was released on 2012-10-12 with total page 0 pages. Available in PDF, EPUB and Kindle. Book excerpt: This volume is an outgrowth of the Second International Workshop on Macroscopic Quantum Coherence and Computing held in Napoli, Italy, in June 2000. This workshop gathered a number of experts from the major Universities and Research Institutions of several countries. The choice of the location, which recognizes the role and the traditions of Naples in this field, guaranteed the participants a stimulating atmosphere. The aim of the workshop has been to report on the recent theoretical and experimental results on the macroscopic quantum coherence of macroscopic systems. Particular attention was devoted to Josephson devices. The correlation with other atomic and molecular systems, exhibiting a macroscopic quantum behaviour, was also discussed. The seminars provided both historical overview and recent theoretical ground on the topic, as well as information on new experimental results relative to the quantum computing area. The first workshop on this topic, held in Napoli in 1998, has been ennobled by important reports on observations of Macroscopic Quantum Coherence in mesoscopic systems. The current workshop proposed, among many stimulating results, the first observations of Macroscopic Quantum Coherence between macroscopically distinct fluxoid states in rf SQUIDs, 20 years after the Leggett's proposal to experimentally test the quantum behavior of macroscopic systems. Reports on observations of quantum behaviour in molecular and magnetic systems, small Josephson devices, quantum dots have also been particularly stimulating in view of the realization of several possible q-bits.

Download or read book Institutions Against Corruption written by Albin Eser and published by Nomos Verlagsgesellschaft. This book was released on 2005 with total page 136 pages. Available in PDF, EPUB and Kindle. Book excerpt: The "Groupe d'Etats contre la corruption" (GRECO) is established at the Council of Europe. GRECO evaluates in several steps the legislative and administrative instruments of its member states in the fight against corruption, and thus makes obligatory suggestions for improvement. Based on the "First Evaluation Round", this study compares the corruption-relevant national regulations of the criminal law and names their weaknesses. Moreover, the book analyzes in which way law enforcement agencies are organized and which authorities are available in the fight against corruption. Additionally, the immunity regulations-which could particularly stand contrary to the fight against corruption in the political sector-are evaluated. Institutions against Corruption systematizes the recommendations passed by GRECO, judges their coherence, and ventures a first assessment. Readers interested in corruption fighting will not only gain comparative legal insights, but also prospects on the recommendations with which GRECO intends to improve the fight against corruption in 35 of its member states.
