Book excerpt: La réparation des accidents du travail et des maladies professionnelles est régie par la loi du 9 avril 1898, loi de compromis votée lors du développement du machinisme et de l'apparition du phénomène accidentel, dans le but de permettre aux salariés victimes de bénéficier d'uen réparation automatique, mais forfaitaire, de leurs dommages. L'intention, louable, qui a animé le législateur du XIXème siècle a cependant rapidement été rattrapée par la réalité et les évolutions juridiques. Les principes posés par la loi de 1898 et par les lois subséquentes, qui interdisent en principe à la vitime d'un accident du travail ou à ses ayants droit d'agir sur le fondement du droit commun, sont en effet de plus en plus critiqués dans la mesure où, paradoxalement, ils sont aujourd'hui moins favorables que ceux qu gouvernent le droit de la responsabilité civile. Cette dernière, notamment caractérisée par le principe de réparation intégrale des préjudices, a en effet fait l'objet de nombreuses transformations, qui ont largement facilité la réparation. Le législateur et la jurisprudence s'efforcent par conséquent de rapprocher le régime des accidents du travail et des maladies professionnelles de la responsabilité civile de droit commun. Cependant, la tendance au rapprochement, voire à l'harmonisation, entre le régime des accidents du travail et des maladies professionnelles et celui de la responsabilité civile, n'est pas univoque. Indéniablement, le contentieux des accidents du travail et des maladies professionnelles a lui aussi une incidence sur la responsabilité civile, en témoigne le fait qu'il soit à l'origine de la découverte de l'obligation de sécurité de résultat pesant sur l'employeur, source d'une systématicité de la dette de réparation. Toutefois, la présente étude s'attache à mettre en exergue que c'est de manière générale, en réalité, que le régime des accidents du travail et des malaies professionnelles est une source d'inspiration du droit de la responsabilité civile, eu égard à la traditionnelle dialectique entre le droit commun et les droits spéciaux. Il existe donc une interdépendance entre le contentieux des accidents du travail et des maladies professionnelles et la responsabilité civie , dans la mesure où ces deux contentieux se servent mutuellement de modèle, et évoluent en contemplation l'un de l'autre.

Book excerpt: The Workshop on the Indemnification of Damage in the Event of a Nuclear Accident, organised by the OECD Nuclear Energy Agency in close so-operation with the French authorities, was held in Paris from 26 to 28 November 2001. this event, which was an integral part of the International Nuclear Emergency Exercise INEX 2000, attracted wide participation from national nuclear authorities, regulators, operators of nuclear installations, nuclear insurers and international organizations. The objective was to test the capacity of the existing nuclear liability and compensation mechanisms in the 29 countries represented at the workshop to manage the consequences of a nuclear emergency such as the accident simulated at the Gravelines nuclear power plant in the north of France in May 2001, and upon which the INEX 2000 Exercise was based. These proceedings contain a comparative analysis of legislative and regulatory provisions governing emergency response and nuclear third party liability, based upon country replies to a questionnaire, the full responses provided to that questionnaire, as well as the texts of presentations made by special quests from Germany and Japan describing the manner in which the public authorities in their respective countries responded to two nuclear accidents of a very different nature and scale.

Book excerpt: Founded in 1919 under the Treaty of Versailles as part of the League of Nations’ system, the ILO is still today the main organization responsible for the international organization of work and the improvement of working conditions in the world. Widely recognized for its efforts in building international labour standards, the ILO remains little studied by development specialists and historians. This book intends to fill this gap and traces the history of international development and its early pioneers, through an analysis of the activities of the International Labour Office, the Secretariat of the International Labour Organization, between 1930 and 1946. In this book, development is used as a key to questioning the ILO's place and function in the expanding inter-war world. The development practices and discourses that emerged in the 1930s were mainly intended to support the ILO's universalization strategy, which was made necessary by the events that shook Europe at the time. Development discourses and practices were also part of the "esprit du temps", as they were closely linked to the affirmation of the planist and rationalist ideas of the 1930s. However, development for the ILO was not reduced to a project of economic modernization, but was seen as a tool for social engineering, as evidenced by the ILO's missions of technical assistance, organized since 1930. The analysis of the expertise work makes it possible to highlight the logics that prevailed in technical assistance, which was more in line with institutional objectives, than with the dissemination of a genuine expertise. This book therefore hopes to bring new insight on the history of internationalism, and international organizations during the inter-war period and the Second World War, as well as on the role of the ILO in the history of international development thinking and practices.

Ahmet Erdi Öztürk illuminates an often-neglected aspect of Turkey’s relations with its Balkan neighbours that emerged as a result of the much discussed ‘authoritarian turn’ – a broader shift in Turkish domestic and foreign policy from a realist-secular to a Sunni Islamic orientation with ethno-nationalist policies.
Öztürk draws on personal testimonies given by both Turkish and non-Turkish, Muslim and non-Muslim interviewees in three country cases: Bulgaria, North Macedonia and Albania. The findings shed light on contemporary issues surrounding the continuous redefinition of Turkish secularism under the AKP rule and the emergence of a new Muslim elite in Turkey.
