Un titre préliminaire expose des généralités sur la vente (son effet translatif, son objet qui soulève des difficultés, la distinction avec d'autres contrats). La responsabilité des vendeurs et fabricants est présentée à revers, en étudiant les obligations de ces derniers, au cours de deux titres. En premier lieu sont abordées les obligations générales, qui ne sont pas propres à la vente, mais découlent du Droit commun des contrats (tout en pouvant jouer envers un vendeur ou un fabricant), tant à l'égard de l'acheteur que des tiers (dont la responsabilité du fait des produits défectueux, longuement analysée). Ensuite, les obligations qu'il est possible de qualifier de spéciales, en ce sens qu'elles sont spécifiques au Droit de la vente : obligation de délivrance conforme ; obligation de garantie (contre l'éviction, contre les vices cachés, et la garantie de la conformité du bien au contrat due par le vendeur au consommateur). L'exposé, le plus clair et le plus complet, dent compte des dernières évolutions légales, jurisprudentielles et de fait, dont les ventes électroniques. L'approche, théorique et concrète, s'appuie sur un nombre considérable de références à des décisions judiciaires, et dent compte de nombreux travaux doctrinaux. Cette nouvelle édition a été largement remaniée et augmentée. Les numéros des pourvois des arrêts de la Cour de cassation ont été systématiquement indiqués, afin de faciliter leur consultation en ligne. Les entrées de l'index ont été sensiblement augmentées.

En outre, il emprunte sa responsabilité à celui d' un sous-traitant agissant pour le compte de l' entrepreneur principal dès lors que le contrat conclu entre eux répond à la qualification de louage d' ouvrage. Ces fabricants sont désormais, conformément à l' article 1792-4 du Code civil, solidairement responsables avec les entrepreneurs-poseurs. La responsabilité civile du fabricant a été concernée au premier chef par le mouvement d' objectivation du droit de la responsabilité civile si bien qu' il relève désormais de la responsabilité objective instaurée par la loi du 19 mai 1998. La nécessité d' assurer l' utilité du matériau au cocontractant impose au fabricant une obligation de conformité relative à la chose objet du contrat. En complément, une obligation de sécurité incombe au fabricant afin de contrebalancer le risque que fait courir l' incorporation des matériaux sur l' ensemble de l' ouvrage et sur les personnes. Ainsi, la dualité du régime juridique découle de cette dissociation de la conformité et de la sécurité. En effet, la non-conformité implique un dommage causé aux matériaux se dissociant du défaut de sécurité consistant en un préjudice causé par les matériaux aux personnes et aux biens.
