Le principe de la responsabilité paternelle calqué du Code Napoléon et la culture endogène se révèlent antinomiques, et l'émergence des enfants en rupture familiale exige d'élargir le champ des répondants. Bien plus, le principe de l'équivalence entre dommage et indemnisation promeut une justice indemnisatrice dont le but prioritaire est de réparer le dommage. Or, face à l'aléa judiciaire, 85 % des jugements restent inexécutés et les victimes désabusées par la «justice des Blancs», d'autant plus que les juridictions coutumières légitimes ont été légalement supprimées, font ressurgir des justices vindicatoires : du simple lynchage au martyr infligé aux enfants par le supplice du collier. Les utopies des paradigmes positivistes interrogent la nécessité de repenser la téléologie de la responsabilité civile; mieux vaut privilégier la réparation du lien, surtout dans un contexte communautaire. L'efficacité du droit se mesure à l'aune de sa légitimité. La coutume juridique transpose plus efficacement et plus justement le droit international ratifié que ne le fait le droit étatique. D'où l'impératif d'une transculturalité juridique intégrant une «médiation palabrique» pour une justice restaurative et un règlement holiste des conflits. Il s'agit de partager l'espace de la juridicité entre l'État et la société civile en triant les atouts et les faiblesses de chaque modèle. Car, en ouvrant l'univers des possibles, il y aura toujours un horizon pour retisser le lien, resocialiser l'enfant, et sauver la paix sociale, raison ultime du droit.

Mais ce nouveau code congolais a aujourd'hui vieilli : la présente étude propose plusieurs pistes de rénovation.

Heterosexuality is celebrated—in film and television, in pop songs and opera, in literature and on greeting cards—and at the same time taken for granted. It is the cultural and sexual norm by default. And yet, as Louis-Georges Tin shows in The Invention of Heterosexual Culture, in premodern Europe heterosexuality was perceived as an alternative culture. The practice of heterosexuality may have been standard, but the symbolic primacy of the heterosexual couple was not. Tin maps the emergence of heterosexual culture in Western Europe and the significant resistance to it from feudal lords, church fathers, and the medical profession. Tin writes that before the phenomenon of "courtly love" in the early twelfth century, the man-woman pairing had not been deemed a subject worthy of more than passing interest. As heterosexuality became a recurrent theme in art and literature, the nobility came to view it as a disruption of the feudal chivalric ethos of virility and male bonding. If feudal lords objected to the "hetero" in heterosexuality and what they saw as the associated dangers of weakness and effeminacy, the church took issue with the “sexuality,” which threatened the Christian ethos of renunciation and divine love. Finally, the medical profession cast heterosexuality as pathology, warning of an epidemic of “lovesickness.” Noting that the discourse of heterosexuality does not belong to heterosexuals alone, Tin offers a groundbreaking history that reasserts the cultural identity of heterosexuality.

The 2018 TZG updates and expands on the guidance in the one previous jointly-developed, zoonoses-specific guidance document: the 2008 Tripartite “Zoonotic Diseases: A Guide to Establishing Collaboration between Animal and Human Health Sectors at the Country Level”, developed in WHO South-East Asia Region and Western Pacific Region. The 2018 TZG supports building by countries of the resilience and capacity to address emerging and endemic zoonotic diseases such as avian influenza, rabies, Ebola, and Rift Valley fever, as well as food-borne diseases and antimicrobial resistance, and to minimize their impacts on health, livelihoods, and economies. It additionally supports country efforts to implement WHO International Health Regulations (2005) and OIE international standards, to address gaps identified through external and internal health system evaluations, and to achieve targets of the Sustainable Development Goals. The 2018 TZG provides relevant country ministries and agencies with lessons learned and good practices identified from country-level experiences in taking OH approaches for preparedness, prevention, detection and response to zoonotic disease threats, and provides guidance on multisectoral communication, coordination, and collaboration. It informs on regional and country-level OH activities and relevant unisectoral and multisectoral tools available for countries to use.

Thereafter the proscriptive content of contemporary norms on the prohibition of the use and recruitment of child soldiers is evaluated, so as to determine whether these norms are capable of better enforcement. An 'issues-based' approach is adopted, in terms of which no specific regime of law, such as international humanitarian law (IHL), is deemed dominant. Instead, universal and regional human rights law, international criminal law and IHL are assessed cumulatively, so as to create a mutually reinforcing web of protection. Ultimately, it is argued that the effective implementation of child soldier prohibitive norms does not require major changes to any entity or functionary engaged in such prevention; rather, it requires the constant reassessment and refinement of all such entities and functionaries, and here, some changes are suggested. International judicial, quasi-judicial and non-judicial entities and functionaries most relevant to child soldier prevention are critically assessed. Ultimately the conclusions reached are assessed in light of a case study on the use and recruitment of child soldiers in the Democratic Republic of the Congo.
