Book excerpt: Un siècle avant la codification, le droit de la responsabilité civile délictuelle et contractuelle apparait d'une étonnante modernité. Les arrêts rendus par le parlement de Toulouse au dix-huitième siècle au terme d'une procédure complexe témoignent d'un contentieux fort varié et aux fondements multiples : fait personnel, fait collectif, fait d'autrui, fait des choses sont sources d'obligation pour qui cause un dommage à autrui. Les documents de la pratique - sacs à procès, factums - attestent pour leur part de la maturité de la pensée juridique du temps. Dans leurs écrits, les avocats parviennent en effet à énoncer dans des formules proches de l'article 1382 les principes qui régissent la matière. En outre, la jurisprudence est reconnue comme une véritable source du droit. Pour autant, le droit de la responsabilité ne s'est pas départi de ses origines romaines. Le Code et le Digeste restent les deux armes principales du plaideur qui entend emporter sa cause, surtout en matière contractuelle. Dans leurs analyses respectives, docteurs et praticiens dégagent nettement les trois éléments constitutifs de la responsabilité civile : le dommage, la faute et le lien de causalité. Ils reconnaissent que leur réunion fait naître au profit de la victime un droit à réparation dont la mise en œuvre résulte d'une action personnelle. Mais dans l'ancien droit, la rigueur des principes est toujours susceptible d'être tempérée par l'équité dont les parlements font un fréquent usage dans un souci de plus grande justice. Ainsi, au dix-huitième siècle, la pratique poursuit l'œuvre de la doctrine des siècles passés et présent dans sa lente marche vers la synthèse du droit. Le Code civil n'en sera que l'ultime expression.

Yet in art and literature women's bodies continued to be represented—and domesticated—by men. They were still more often the object of the artist's or writer's gaze than they were the subject of their own representing processes. The erotic potential of women's bodies, however, was far from a marginal concern in the elaboration of modern forms of politics, art, literature, and psychology. In Eroticism and the Body Politic, scholars from art history, history, and literature examine the frequent intersections between the body erotic and the body politic. Focusing on eighteenth- and nineteenth-century France, they show how eroticized representations of bodies had a multitude of political and cultural meanings. The authors consider the eroticized body in a wide variety of media: from Fragonard's paintings of "erotic mothers," to political pornography attacking Marie Antoinette, to the "new woman" of fin de siècle decorative arts. Exploring the possibilities of a multidisiplinary approach, the volume shows that eroticism had an impact far beyond the usual confines of libertine or pornographic literature—and that politics included much more than voting, meeting, or demonstrating. It demonstrates how the episcopate, initially demoralised by the Wars of Religion, developed a powerful ideology of privilege, leadership and pastorate that enabled it to become a flourishing participant in the religious, political and social life of the ancien regime. The book analyses the attitudes of Tridentine bishops towards their office by considering the French episcopate as a recognisable caste, possessing a variety of theological and political principles that allowed it to dominate the French church.
