Book excerpt: El tema de esta investigación resulta de las soluciones divergentes que vienen haciendo los jueces en relación con los casos de negligencia u omisión médica, pues en algunas ocasiones encontramos que ante estas situaciones, en tanto que en primera instancia el juez resuelve el caso como responsibilidad por omisión o negligencia médica y condena por la totalidad del perjuicio, como debe ser, en segunda instancia modifican la sentencia y la misma situación omisiva la consideran como constitutiva de resonsabilidad por pérdida de oportunidad, lo que conlleva a una rebaja sustancial de la indemnización de perjuicios, pues conforme a esta teoría no se indemniza por el daño final sino por el porcentaje de la oportunidad perdida, cuando no, en el peor de los casos, sólo indemnizan un rubro que denominan pérdida de oportunidad como perjuicio autónomo e independiente.

Book excerpt: La pérdida de la oportunidad, actualmente, se ha convertido en una figura recurrente en los procesos de responsabilidad civil y del Estado, en especial en el ámbito médico sanitario, no obstante, siguen existiendo inconvenientes en cuanto a su verdadero alcance y los requisitos que deben demostrarse para que la misma pueda ser aplicada a un caso particular. Por lo anterior, en esta segunda edición se insiste en considerar la pérdida de la oportunidad como un daño autónomo y Cierto, no como un perjuicio, que es susceptible de generar unas consecuencias que merecen ser reparadas conforme a la tipología tradicional de los perjuicios, para lo cual se corrobora la necesidad de diferenciar el daño del perjuicio y se agrega un análisis sobre los conceptos de existencia, situación potencialmente apta y porcentaje de probabilidad que constituyen tres aspectos diferentes de la figura y tienen relación estrecha con el carácter cierto del daño. También se amplía el estudio de los requisitos que se consideran indispensables para la configuración de un daño por perdida de la oportunidad, y que vienen siendo aceptados por la jurisprudencia colombiana con el ánimo de evitar la confusión de considerar esta figura como un daño subsidiario, o un argumento para Violar el principio de congruencia bajo el pretexto de estar interpretando la demanda. De esta manera se pretende con este trabajo reflexionar sobre la postura de autores foráneos para quienes la doctrina de la pérdida de la oportunidad es una regla de facilitación probatoria del nexo causal para demostrar que dicha interpretación, a nuestro entender no es de recibo, pues se considera que la mejor manera de abordar el estudio de la figura es desde el ámbito del daño y no desde la imputación, de tal forma que en la práctica solo pueda acudirse a ella cuando haya sido solicitada expresamente su reparación, se hayan acreditado cada uno de los requisitos que la configuran, y se hayan demostrado, además del daño, los otros elementos de la responsabilidad, esto es, la imputación y el fundamento del deber de reparar.

Como uno de los ambitos en los que la responsabilidad por perdida de oportunidad esta demostrando su gran capacidad de actuacion es el sanitario y del derecho a la salud. Por eso se constituye en eje central de este trabajo.

Book excerpt: In 1982 the International Association on Water Pollution Research and Control (IAWPRC), as it was then called, established a Task Group on Mathematical Modelling for Design and Operation of Activated Sludge Processes. The aim of the Task Group was to create a common platform that could be used for the future development of models for COD and N removal with a minimum of complexity. As the collaborative result of the work of several modelling groups, the Activated Sludge Model No. 1 (ASM1) was published in 1987, exactly 25 years ago. The ASM1 can be considered as the reference model, since this model triggered the general acceptance of wastewater treatment modelling, first in the research community and later on also in practice. ASM1 has become a reference for many scientific and practical projects, and has been implemented (in some cases with modifications) in most of the commercial software available for modelling and simulation of plants for N removal. The models have grown more complex over the years, from ASM1, including N removal processes, to ASM2 (and its variations) including P removal processes, and ASM3 that corrects the deficiencies of ASM1 and is based on a metabolic approach to modelling. So far, ASM1 is the most widely applied. Applications of Activated Sludge Models has been prepared in celebration of 25 years of ASM1 and in tribute to the activated sludge modelling pioneer, the late Professor G.v.R. Marrais. It consists of a dozen of practical applications for ASM models to model development, plant optimization, extension, upgrade, retrofit and troubleshooting, carried out by the members of the Delft modelling group over the last two decades.
