Book excerpt: El tema escogido para este trabajo, El periodo de responsabilidad del porteador en el transporte marítimo, obedece a una pregunta que desde antaño ha sobrevolado la mente de los juristas, académicos y prácticos, dedicados a las cuestiones marítimas: ¿cuáles son los extremos que acotan la responsabilidad del porteador en el viaje marítimo? El periodo de responsabilidad constituye, sin lugar a dudas, uno de los más importantes aspectos legales del contrato de transporte. Permite a las partes que participan en la ejecución de un contrato, especialmente al porteador, conocer en qué momento comienza y termina su responsabilidad, pudiendo estas anticipar sus riesgos y diseñar sus estrategias comerciales consecuentemente. Los ya cerca de un centenar de años de experiencia en su aplicación y análisis revelan sobradamente lo difícil que resulta la interpretación uniforme del Convenio de Bruselas de 1924 en este punto. Las Reglas de Hamburgo de 1978 supusieron un significativo avance, pero la escasa repercusión que han tenido en el panorama del comercio internacional ha llevado a su olvido. Recientemente UNCITRAL-CNUDMI ha elaborado un nuevo Instrumento que, por primera vez, pretende regular en su totalidad el contrato de transporte internacional de mercancías. Las Reglas de Rotterdam disciplinan de forma algo más precisa, aunque veremos si con igual éxito, el periodo de responsabilidad del porteador, tratando de dar solución a la disparidad doctrinal y jurisprudencial que en torno a este periodo existe. En medio de esta concurrencia de textos internacionales, nuestro país conoce desde 2014 una nueva Ley de Navegación Marítima. La opción elegida por el legislador parece haber acabado con la diversidad interpretativa, situando a nuestro país entre aquellos que disponen de una norma imperativa aplicable a esa fase portuaria del transporte.

Book excerpt: La presente obra aborda la cuestión más destacada del contrato de transporte, y en especial del contrato de transporte marítimo internacional de mercancías: la responsabilidad del porteador y la carga de la prueba. El porteador asume la obligación de transportar las mercancías de un lugar a otro por vía marítima, y se constituye como uno de los principales actores del comercio marítimo. En el momento en el que el cargador pone a disposición del porteador las mercancías, pierde el control sobre las mismas y es entonces cuando sólo el porteador está en situación de proteger la carga para que llegue a destino incólume, en el mismo estado en el que la recibió. Por ese motivo, es de justicia responsabilizar al porteador por el incumplimiento contractual, pero es igualmente equitativo que se haga en su justa extensión y medida en aras de lograr un régimen adecuado. La extensión del régimen de responsabilidad del porteador ha sido el problema central en los Convenios Internacionales que regulan el contrato de transporte marítimo (e incluso en otros Convenios que regulan el transporte por otros modos), tal y como se desprende en el estudio de las Reglas de La Haya Visby y con posterioridad de las Reglas de Hamburgo y las Reglas de Rotterdam. El objetivo principal de esta monografía es identificar y evaluar la responsabilidad del porteador y la carga de la prueba (y de otros sujetos a lo que la regulación convencional imponga la responsabilidad en los mismos términos que al porteador) por los daños, pérdidas y retraso en la entrega de las mercancías en las Reglas de Rotterdam a través de la comparación con las Reglas de La Haya-Visby y Hamburgo, para finalmente concluir sobre la idoneidad del nuevo régimen adoptado por las Reglas de Rotterdam. Por otra parte, y directamente relacionado con lo anterior, se ha estimado conveniente realizar un breve estudio del régimen de responsabilidad del porteador de la Ley de Navegación Marítima española para dar a conocer su origen, contenido y la problemática que plantea su regulación.
