Book excerpt: Era maniquea y facilona la distinción que quería convencer de que las actividades médicas se gobiernan por la regla de las obligaciones de medios (de modo que el médico solamente responde si su actuación no ha sido diligente, con independencia del éxito o fracaso de la misma), pero ello siempre con la excepción de las actividades propias de la medicina voluntaria, y que tomaba como ejemplo de esta última a la cirugía estética. Y también era distinción perniciosa. Doy fe de que algunos cirujanos estéticos, cuando se encontraban ante profesores o jueces que participaban de esta manera de ver las cosas, mostraban su completo desacuerdo. La autora hace ver que la cirugía estética, y en general la denominada medicina voluntaria, se debe evaluar en clave de responsabilidad subjetiva o por culpa, lo que obligará a la demostración de la negligencia del facultativo. Ello, por más que esa prueba se pueda obtener por la vía de las presunciones de hecho que se integran en la doctrina del daño desproporcionado, y sin desdeñar el hecho de que en el conglomerado de obligaciones que se dan cita en la actividad médica, siempre hay o puede haber parciales o fragmentarios resultados exigibles (vgr., las pruebas preoperatorias) cuya no obtención sirva, al tiempo que para poner en evidencia el incumplimiento de un concreto deber de resultado, para demostrar también la existencia de negligencia en la prestación del servicio. Esos contratos mixtos con prestaciones subordinadas se hallan presentes, en fin, en las más modernas construcciones doctrinales. No están ausentes en esta obra las reflexiones sobre el consentimiento informado, que a veces servirán para demostrar que fue, en efecto, un resultado lo que se garantizó al paciente. Ni tampoco las siempre polémicas cuestiones de la tan discutida y discutible yuxtaposición de responsabilidades contractual y extracontractual. Junto con lo anterior, se elabora una nueva taxonomía de los daños estéticos y se plantea un novedoso enfoque respecto del consentimiento informado en el ámbito de la cirugía plástica estética, proponiendo nuevas áreas a las que debiese extenderse el deber de información a los pacientes, por parte de los galenos, también recurriendo a los conocimientos técnicos provistos por la cirugía plástica. Se estima que este libro será de utilidad para abogados y médicos que deseen interiorizarse en la forma de afrontar conflictos jurídicos por mala praxis en el ámbito de la cirugía plástica.
