Book excerpt: El Ordenamiento Jurídico ha dedicado atención, desde época muy temprana, a la regulación del estatuto jurídico del personal que prestaba servicios en régimen laboral en los establecimientos del Ejército. De esta forma se ha ido configurando una singular relación jurídica profesional -la del personal civil no funcionario al servicio de establecimientos militares- y una amplia normativa específica aplicable a la misma, si bien esta normativa siempre ha estado separada del tronco laboral común. La normativa específica reguladora debería de haber compatibilizado los fines y principios del Derecho del Trabajo con los del Ejército, cosa que rara vez se ha conseguido de forma satisfactoria. En una relación como la del personal civil no funcionario al servicio de establecimientos militares es estrictamente necesario averiguar el fundamento político-jurídico de la misma, ya que ninguna otra razón concluyente da explicación a la situación jurídica en la que se encuentra el personal laboral incluido dentro de esta relación. No existen razones objetivas que justifiquen el peculiar régimen aplicable a este personal. Las razones que han sido alegadas para fundamentar la existencia y el mantenimiento de la relación laboral del personal civil no funcionario al servicio de establecimientos militares no son lo suficientemente profundas y concluyentes como para justificar el mantenimiento de la relación sometida a un régimen jurídico totalmente separado del laboral común. Por ello, cabe afirmar que es el peso que la tradición ha ejercido la que ha venido a mantener la relación del personal civil no funcionario al servicio de establecimientos militares como relación sometida a una normativa específica que la diferencia del resto de las relaciones laborales. El objeto de esta investigación es el análisis del régimen del personal que es civil, y que por tanto carece de las características del militar, que no es funcionario sino que está ligado al empresario (Administración Militar Ministerio de Defensa) a través de una relación que reúne las notas de laboralidad (trabajo humano, voluntario, productivo, en régimen de dependencia y ajeneidad) y que presta servicios en centros o establecimientos militares. En la tarea de definición y delimitación de los conceptos "personal civil no funcionario" ocupa especial relevancia un colectivo que está incluido dentro del mismo, pero que tiene características propias y regulación particular, se trata del personal civil no funcionario al servicio de las fuerzas de los EE.UU. en España. Asimismo en la delimitación del objeto de este estudio cobra especial relevancia la definición y aclaración de los términos "establecimiento militar". En consecuencia, se propone estudiar el régimen jurídico de la prestación de servicios de este personal desde un punto de vista crítico. Ello se puede hacer, dado el contenido de las normas que lo regulan, realizando un estudio basado en una comparación (paralelismo) entre un esquema del régimen jurídico de las relaciones laborales privadas y de éste, que lógicamente y por interés de los trabajadores se intenta reconducir a aquél. Se estudia pues: -El marco normativo (con alusión a sus antecedentes históricos) y las cuestiones de legalidad que plantea y problemas de aplicación e interpretación de esas normas (derecho supletorio...). -La configuración, caracterización y definición de la relación del personal civil no funcionario. -El régimen jurídico de las relaciones de estos trabajadores con la Administración Militar. -El régimen jurídico de las relaciones colectivas de trabajo. -Las especialidades en el tema de la Administración Laboral (Inspección de Trabajo), del Procedimiento Laboral y de la Seguridad Social. - Y por último, el régimen jurídico aplicable al personal civil no funcionario al servicio de las Fuerzas Armadas de los Estados Unidos en España. Dada la enorme complitud de este potencial estudio se advierte que se dedicará una atención general a cada uno de los temas propuestos y una atención especial a las relaciones colectivas de trabajo.
