Desde su aparición ha sido objeto de todo tipo de opiniones, algunas a favor de que se castigue con una pena superior al sujeto que recae en un delito; otras en pos de que sea eliminada del catálogo de agravantes, por su falta de adecuación a los principios y mandatos de nuestra CEo En este trabajo se hará un análisis de su regulación en nuestro CP, es decir, se llevará a cabo un estudio respecto de cuáles son sus requisitos, caracteres, efectos y, también, un breve examen comparativo con otras figuras similares. Pero sin duda el fundamento es el aspecto que más controversia ha generado; se examinarán las tesis más difundidas, también utilizadas por el TS en la justificación de la agravación de la pena a imponer al sujeto que es reincidente. Por último, porque su fundamento resulta muy cuestionado, se entrará a analizar los argumentos que ha dado el TC para defender la constitucionalidad de esta circunstancia agravante.
