Pero sin duda el fundamento es el aspecto que más controversia ha generado; se examinarán las tesis más difundidas, también utilizadas por el TS en la justificación de la agravación de la pena a imponer al sujeto que es reincidente. Por último, porque su fundamento resulta muy cuestionado, se entrará a analizar los argumentos que ha dado el TC para defender la constitucionalidad de esta circunstancia agravante.
