L'intensification de l'activité, des tâches de plus en plus mentales, le stress sont autant de facteurs qui peuvent développer chez le travailleur des troubles psychiques. La loi de modernisation sociale est un tournant important pour le droit à la santé au travail. Le Code du travail reconnaît désormais expressément la santé mentale. Toutefois, la reconnaissance en elle-même ne suffit pas à instaurer un régime propre à préserver la santé mentale au travail. L'accent doit etre porté sur la prévention des risques d'atteinte à la santé psychique des travailleurs. Les personnes fragiles psychologiquement en seront les premières bénéficiaires. Comme le droit à la santé physique au travail, le travailleur doit pouvoir jouir d'un droit à la protection de sa santé mentale et sa personne doit être replacée au cœur de la relation contractuelle.

Ces problèmes sont largement attribuables aux transformations intervenues dans le monde du travail. Les nouveaux modes d'organisation du travail et le développement des technologies ont entraîné des contraintes émotionnelles et cognitives importantes. La libéralisation des économies a imposé aux entreprises des exigences de compétitivité qui ont été, en grande partie, relayées aux employés. En somme, si les risques physiques ont diminué, les risques pour la santé mentale des travailleurs n'ont cessé d'augmenter. Dans cette perspective, l'auteur examine l'existence et l'efficacité d'un droit à la protection de la santé mentale au travail, d'abord en droit international puis dans le droit applicable au Québec. Elle soutient que la pleine réalisation de ce droit nécessite de l'envisager sous l'angle de la prévention des risques psychosociaux, en tant que partie intégrante des régimes de protection de la santé et de la sécurité au travail. L'approche de l'Europe communautaire et, en particulier, l'analyse du droit belge fournissent des ; pistes de solutions à cet égard. Au Québec, la logique contraignante du régime, centré sur la réparation des atteintes, et l'effet combiné des recours qu'il aménage posent obstacle à l'intervention préventive concertée. Afin de remédier à la situation, l'auteur propose une réorientation en faveur d'un régime qui favorise la prévention des risques psychosociaux et la mise en place de politiques publiques favorables à la santé mentale.

Book excerpt: One of the principal tasks for legal research at the beginning of the 21st century is to reconstruct the understanding of the relationship between the legal system and the market order. After almost three decades of deregulation driven by a belief in the self-equilibrating properties of the market, the financial crisis of 2008 has reminded everyone of the fundamental truth that markets have legal and institutional foundations, without which they cannot effectively function. The chapters in the present volume are the result of work by a group of legal scholars which began in the mid-2000s, at a time when the shortcomings of deregulatory policies were becoming clear in a number of contexts. The chapters address the question of how the language of contract law describes or conceptualises the market order and the relationship of the law to it. The perspectives taken are, in turn, historical, comparative, and context-specific. The focus of the book is on a foundational idea, the concept of capacitas, which signifies a status conferred upon citizens for the purpose of enabling them to participate in the economic life of the polity. In modern legal systems, 'capacity' is the principal juridical mechanism by which individuals and entities are empowered to enter into legally binding agreements and, more generally, to arrange their affairs using the instruments of private law. Legal capacity is thereby the gateway to involvement in the operations of a market economy.

This book explores its development and analyses the penological and human rights foundations on which it is based. It examines the findings of the European Committee for the Prevention of Torture, the recommendations of the Council of Europe, and the judgments of the European Court of Human Rights. From these sources it makes the general principles that underlie European prison law and policy explicit, emphasising the principle of using imprisonment as a last resort and the recognition of prisoners' rights. The book then moves on to apply these principles to conditions of imprisonment, regimes in prison, contacts between prisoners and the outside world, and the maintenance of good order in prisons. The final chapter of the book considers how European prison law and policy could best be advanced in future. The authors argue that the European Court of Human Rights should adopt a more proactive approach to ensuring that imprisonment is used only as a last resort, and that a more radical interpretation of the existing provisions of the European Convention on Human Rights will allow it to do so. It concludes that the growing cooperation on prison matters within Europe bodes well for the increased recognition of prisoners' rights across Europe. In spite of some countervailing voices, Europe should increasingly be able to give an international lead in a human rights approach to prison law and policy in the same way it has done with the abolition of the death penalty.
