Book excerpt: This book is about one of the most controversial dilemmas of contract law: whether or not the unexpected change of circumstances due to the effects of financial crises may under certain conditions be taken into account. Growing interconnectedness of global economies facilitates the spread of the effects of the financial crises. Financial crises cause severe difficulties for persons to fulfill their contractual obligations. During the financial crises, performance of contractual obligations may become excessively onerous or may cause an excessive loss for one of the contracting parties and consequently destroy the contractual equilibrium and legitimate the governmental interventions. Uncomfortable economic climate leads to one of the most controversial dilemmas of the contract law: whether the binding force of the contract is absolute or not. In other words, unstable economic circumstances impose the need to devote special attention to review and perhaps to narrow the binding nature of a contract. Principle of good faith and fair dealing motivate a variety of theoretical bases in order to overcome the legal consequences of financial crises. In this book, all these theoretical bases are analyzed with special focus on the available remedies, namely renegotiation, rescission or revision and the circumstances which enables the revocation of these remedies. The book collects the 19 national reports and the general report originally presented in the session regarding the Effects of Financial Crises on the Binding Force of Contracts: Renegotiation, Rescission or Revision during the XIXth congress of the International Academy of Comparative Law, held in Vienna, July 2014.

Book excerpt: Institutionalizing Gender analyzes the relationship between class, gender, and psychiatry in France from 1789 to 1900, an era noteworthy for the creation of the psychiatric profession, the development of a national asylum system, and the spread of bourgeois gender values. Asylum doctors in nineteenth-century France promoted the notion that manliness was synonymous with rationality, using this "fact" to pathologize non-normative behaviors and confine people who did not embody mainstream gender expectations to asylums. And yet, this gendering of rationality also had the power to upset prevailing dynamics between men and women. Jessie Hewitt argues that the ways that doctors used dominant gender values to find "cures" for madness inadvertently undermined both medical and masculine power—in large part because the performance of gender, as a pathway to health, had to be taught; it was not inherent. Institutionalizing Gender examines a series of controversies and clinical contexts where doctors' ideas about gender and class simultaneously legitimated authority and revealed unexpected opportunities for resistance. Chouki El Hamel argues that we cannot rely solely on Islamic ideology as the key to explain social relations and particularly the history of black slavery in the Muslim world, for this viewpoint yields an inaccurate historical record of the people, institutions and social practices of slavery in Northwest Africa. El Hamel focuses on black Moroccans' collective experience beginning with their enslavement to serve as the loyal army of the Sultan Isma'il. By the time the Sultan died in 1727, they had become a political force, making and unmaking rulers well into the nineteenth century. The emphasis on the political history of the black army is augmented by a close examination of the continuity of black Moroccan identity through the musical and cultural practices of the Gnawa.
