La récurrence et la persistance des débats en la matière prouvent que ce concept ne traduit pas qu'un phénomène conjoncturel. Ces raisons conduisent par conséquent à lui consacrer une étude afin de déterminer la pertinence de son admission en droit d'auteur. L'étude part du constat qu'un nombre croissant d'auteurs ont volontairement recours à des oeuvres originelles créées par autrui pour aboutir à la création d'une oeuvre nouvelle. Le législateur a certes envisagé l'hypothèse dans laquelle une oeuvre nouvelle procède d'une oeuvre préexistante au travers de la catégorie légale des oeuvres composites. Cependant, les dispositions éparses qui lui sont consacrées souffrent d'une terminologie et d'un régime imprécis qui s'accordent mal avec l'infinie diversité des formes d'emprunt créatif à l'oeuvre d'autrui. L'étude renouvelée de cette catégorie légale à l'aune de ces pratiques qui ont pris une nouvelle dimension aboutit dans un premier temps à circonscrire la notion fonctionnelle d'oeuvre transformatrice. Il s'avère que, bien souvent, l'auteur de l'oeuvre transformatrice a réalisé son oeuvre sans l'autorisation de l'auteur de l'oeuvre originelle, et leurs droits entrent alors en conflit. C'est la raison pour laquelle l'étude s'attelle, dans un second temps, a? appréhender ce conflit de droits en proposant un régime de l'oeuvre transformatrice.

Ladd-Taylor argues that mother-work, "women's unpaid work of reproduction and caregiving," motivated women's public activism and "maternalist" ideology. Mothering experiences led women to become active in the development of public health, education, and welfare services. In turn, the advent of these services altered mothering in many ways, including the reduction of the infant mortality rate.
