Book excerpt: La loi du 22 juillet 2018 réforme principalement – mais partiellement – les régimes matrimoniaux. Les modifications portées par cette loi sont néanmoins substantielles car, d'une part, elles codifient un certain nombre d'acquis doctrinaux et jurisprudentiels, et, d'autre part, elles créent de nouvelles normes et qualifications en la matière. Ainsi, dans le régime légal, les droits de nature personnels et leur valeur économique, les indemnisations personnelles et patrimoniales, les assurances vie individuelles, le partage des biens, les attributions préférentielles et les apports de biens propres ont été notamment repensés et codifiés. En séparation de biens pure et simple, la réforme la plus notable porte sur l'extension à ce régime de la théorie des avantages matrimoniaux, pour tenter de mettre, au moins partiellement, fin aux controverses existant à ce propos. Le séparatisme rigoureux de ce régime peut désormais être atténué par une correction en équité qui, si elle est généreuse dans son principe, ne manquera sans doute pas de faire débat chez les praticiens. Le régime de la participation aux acquêts a été introduit dansnnotre arsenal législatif, et sa codification a été réalisée dans la perspective de lui assurer une meilleure assise notariale. La réforme ouvre donc de nouvelles perspectives patrimoniales, et incite plus que jamais à la créativité lors de la rédaction du contrat de mariage.
