Book excerpt: La loi n° 2004-130 du 11 février 2004 réformant le statut de certaines professions judiciaires ou juridiques, des experts judiciaires, des conseils en propriété industrielle et des experts en ventes aux enchères publiques vise à moderniser le statut de nombreuses professions du droit ou participant au service public de la justice. Son premier volet, consacré aux avocats, apporte de nombreuses retouches à la loi du 31 décembre 1971 portant réforme de certaines professions judiciaires et juridiques, afin de répondre aux impératifs nouveaux liés à la construction européenne. Ainsi, elle élargit les conditions d'accès à la profession d'avocat ouvrant aux avocats communautaires le droit d'exercer leur profession dans un autre Etat que celui dans lequel ils ont acquis leur qualification. L'organisation de la formation initiale et continue sera profondément réformée. Enfin, la procédure disciplinaire est rénovée, afin de la rendre plus conforme aux exigences du procès équitable et plus respectueuse des droits de la défense. Dans la même logique, le second axe de la loi décline une série dé mesures pour améliorer le statut d'autres professions juridiques. Il renforce le régime des experts judiciaires en rénovant leur régime disciplinaire et en définissant des critères plus stricts de sélection permettant de garantir un recrutement de qualité. Une clarification des règles déontologiques applicables aux conseils en propriété industrielle sera également opérée et les conditions d'exercice des huissiers de justice facilitées. Le présent ouvrage donne accès à la loi publiée au journal officiel " Lois et décrets " du 12 février 2004 ; aux textes législatifs à jour des modifications induites par l'adoption de la loi ; au contexte d'adoption de la loi, à travers des extraits des travaux préparatoires du Parlement, une sélection des réponses gouvernementales aux questions écrites de parlementaires et des passages d'avis ou documents publics se rapportant au thème des professions juridiques et judiciaires ; à un index qui permet d'établir un lien entre la loi publiée et le droit en vigueur issu de sa publication ainsi qu'avec les travaux préparatoires du Parlement.

Based on the French experience from 1274 until 1994, this book stimulates areappraisal of lawyers' collective action in English-speaking countries as well as on the Continent. In a unique and lively combination of history and sociology, the book follows the evolution of French lawyers from the birth of the bar to the present day. Their history encompasses three different forms of the profession and three distinct types of lawyers. The 'State bar', which existed in theremote past, was based on individual navigation between the courts of justice and the royal court. The 'Public' or 'Classical bar', which lasted from the end of the seventeenth century to the middle of the twentieth century, was centered around politics and as a result became one of the builders ofthe liberal State. Finally, contemporary lawyers are increasingly dominated by the 'Business bar', and their practices form the basis of a systematic study of the market, hierarchy, work, sociability and self-government. The author advances and tests a wide range of new theories: on collegial power; on collective action, by explaining how a profession can become a lasting political movement or a how weak political actor can become a ruling elite; on the state and intermediate groups; on professional markets, byproposing an 'economics of quality' in place of neoclassical economics. He also presents creative perspectives on lawyers' stratification and sociability. Through the vivid presentation of a singular case, and the blending of qualitative and quantitative methods, this book develops an original perspective in socio-legal studies and historical sociology. It also makes important contributions to the sociology of professions, to the study of collectiveaction, and to economic and political sociology.

Mais c'est aussi la pluralité des enjeux entourant ces professions qui interpelle. Il suffit de constater les bouleversements qu'ont connus les professions réglementées ces dernières années. Critiquées, elles ont donné lieu à la loi n° 2015-990 du 6 août 2015 pour la croissance, l'activité et l'égalité des chances économiques qui est venue apporter des modifications notables à leur réglementation. Comment ces professions ont-elles accueilli cette réforme ? Quelles sont les nouvelles problématiques rencontrées et quelles pistes d'amélioration peuvent être proposées ? Déstabilisées, ces professions subissent l'activité croissante des plateformes numériques qui permettent à des entrepreneurs indépendants, voire à de simples particuliers, de proposer des prestations directement en concurrence avec les leurs, sans être soumises aux mêmes contraintes. Face à l'innovation technologique et à cette forme de distorsion de concurrence, le législateur a déjà commencé à encadrer ces activités " disruptives ". Il est dès lors possible d'examiner de façon critique les solutions adoptées mais également d'envisager de nouvelles perspectives. Globalisées et structurées, les professions réglementées doivent être envisagées tant dans en droit interne que dans leur déploiement à l'international et en particulier au sein de l'Union Européenne. C'est aussi l'observation de secteurs professionnels spécifiques qui est particulièrement propice à l'enrichissement de la réflexion. Faire un point d'étape sur l'état actuel des professions réglementées, clarifier les questionnements et faire des propositions sur un mode prospectif, telles sont les ambitions de l'ouvrage.
