Available in PDF, EPUB and Kindle. Book excerpt: European Monographs Series, Volume 9 This second and much-revised edition of the pre-eminent work on European Union (EU) agricultural law emphasises the sweeping changes that have led to the gradual expansion of the common agricultural policy to encompass the food chain as a whole. Although the new edition’s purpose and methodology remain the same, the author presents a completely new overview of the field as it now exists, including the effects of the latest reform measures up to 2021 and their implications for the future. Imparting in-depth awareness of the multifunctional character of agriculture today – its importance for environmental protection, preservation of biodiversity, public health, mitigation of climate change, and rural development, as well as its international obligations – the book provides matchless insight and clarifications on such critical legal details as the following: analysis of the Green Deal, the Farm to Fork Strategy, and the Biodiversity Strategy for 2030; extensive treatment of the TFEU provisions on agriculture and the impact of international legal instruments; clear and easily accessible treatment of the legislation on market and price policy, competition, and the agri-food chain; thorough analysis of administrative law aspects, in particular, the rights and obligations of operators in the framework of numerous subsidy arrangements and related topics such as sanctions and force majeure; and in-depth treatment of the importance of the general principles of EU law for legal protection. Given that about one-third of the EU’s budget is spent on agriculture – and that European legislation on agriculture is voluminous and complicated and case law is abundant – this well-organised and lucid exposition will be of immeasurable value to any practitioner asked to deal with a case involving agriculture anywhere in the EU. Academics aware of the growing intricacy of the field will welcome the author’s reflections on the meaning and significance of EU agricultural law.

Book Production Rights in European Agriculture

Download or read book Production Rights in European Agriculture written by D. Barthelemy and published by Elsevier. This book was released on 2001-05-21 with total page 268 pages. Available in PDF, EPUB and Kindle. Book excerpt: Rather than simply cataloging the various interpretations of European regulations by Member States, this international team examines the economic priorities, the legal bases, the social norms and cultural patterns which come into play, presenting an analytical approach to the study of production rights in European agriculture. This work traces the emergence and the economic and legal content of the different income support tools for agricultural producers, collectively termed 'production rights' and it looks at the foundations of the specific national conceptions underlying the methods of organising agricultural activity. The book is intended for a varied readership: farmers themselves, of course, but also economic, legal and tax consultants, experts, lawyers, notaries, as well as students, teachers and researchers. It has been set out in such a way as to allow readers to move freely from one subject to another, depending on whether their interest lies in economic aspects or legal developments, or whether they are more concerned by certain production rights or by certain features of their own organisation. The goal of the book is to enable the reader to grasp the special features and the significance of the forces which have shaped the current income support instruments for producers in the various Member States of the EU, and which will unquestionably continue to influence the measures which flow from reforms to the Common Agricultural Policy in the years to come.

Book From Dual to Cooperative Federalism

Download or read book From Dual to Cooperative Federalism written by Robert Schütze and published by OUP Oxford. This book was released on 2013-01-31 with total page 432 pages. Available in PDF, EPUB and Kindle. Book excerpt: What is the federal philosophy inspiring the structure of European law? The federal principle stands for constitutional arrangements that find "unity in diversity". The two most influential manifestations of the federal principle emerged under the names of "dual" and "cooperative" federalism in the constitutional history of the United States of America. Dual federalism is based on the idea that the federal government and the State governments are co-equals and each is legislating in a separate sphere. Cooperative federalism, on the other hand, stands for the thought that both governments legislate in the same sphere. They are hierarchically arranged and complement each other in solving a social problem. Can the European Union be understood in federal terms? The book's general part introduces three constitutional traditions of the federal idea. Following the American tradition, the European Union is defined as a Federation of States as it stands on the "middle ground" between international and national law. But what federal philosophy has the European Union followed? The special part of the book investigates the structure of European law. Three arguments are advanced to show the evolution of the European legal order from dual to cooperative federalism. The first looks at the decline of constitutional exclusivity on the part of the Member States and the European Union. For almost all objects of government, the Union and its States operate in a universe of shared powers. The second argument analyses the decline of legislative exclusivity. European and national legislation - increasingly - complement each other to solve a social problem. The third argument describes the "constitutionalisation" of cooperative federalism in the form of the principle of subsidiarity and the idea of complementary competences. A final Chapter is dedicated to Europe's foreign affairs federalism. It analyses, whether the external sphere must be regarded as subject to different constitutional or federal principles. The book concludes that cooperative federalism will benefit both levels of government - the Union and the Member States - as the constitutional mechanism of uniform European standards complemented by diverse national standards best expresses the federal idea of "unity in diversity".

Book Prospects for a sustainable dairy sector in the Mediterranean

Download or read book Prospects for a sustainable dairy sector in the Mediterranean written by M. Djemali and published by BRILL. This book was released on 2023-08-28 with total page 454 pages. Available in PDF, EPUB and Kindle. Book excerpt: Dairy products have always constituted an essential component in the Mediterranean diet. In addition to their nutritional values, they represent also a part of the cultural heritage of the people. Prospects for a sustainable dairy sector in the Mediterranean, preconditions for its development and the future consumers' demand were some of the issues covered by the papers presented at the EAAP - CIHEAM - FAO Mediterranean symposium. It was organised by the Tunisian Office for Livestock and Pastures and the National Agronomic Research Institute and sustained by the Government of Tunisia, FAO, ICAR and CIRVAL. Over 280 participants from 25 countries participated. The symposium identified a variety of technically viable and scientifically sound policy options and defined the main fields requiring further scientific research and the development of new sustainable technologies. The available technologies to address intensive, semi intensive and extensive production systems and the existing institutional framework (research, education, extension systems, organisation of the sector), although requiring continuous adjustments and improvements, have proved to be in a position to meet a variety of demands and challenges. In this respect, the Symposium called for an increase in research for the semi-intensive farming systems in the South and emerging issues resulting from changes in agricultural policies in the North. It emphasised the importance of producers1 associations as representatives of the interests of the sector and partners in the overall dialogue on policy matters and in the identification of research needs. The Symposium confirmed the wish and capacity of the dairy sector in the Region to contribute to the sustainable rural development, to the creation of new employment opportunities and to the reasonable and harmonious management of the natural resources.
