Considered the most forward looking regional agreement of the time, it influenced significantly the development of environmental law in Africa. Two and a half decades of intense developments in international environmental law made it necessary to revise this treaty, update its provisions and enlarge its scope. This was undertaken under the auspices of the African Union (previously OAU), and the revision was adopted by its Heads of State and Government in July 2003 in Maputo. The introduction provides an overview of this new international treaty, as well as a commentary to each of its provisions.

These rights are not established by states; rather, they are inherent to indigenous peoples because of their human dignity, historical continuity, cultural distinctiveness, and connection to the lands where they have lived from time immemorial. In the past decades, a new awareness of the importance of indigenous rights has emerged at the international level. UN organs have adopted specific international law instruments that protect indigenous peoples. Nonetheless, concerns persist because of continued widespread breaches of such rights. Stemming from a number of seminars organised at the Law Department of the University of Roma Tre, the volume includes contributions by distinguished scholars and practitioners. It is divided into three parts. Part I introduces the main themes and challenges to be addressed, considering the debate on self-determination of indigenous peoples and the theoretical origins of ‘indigenous sovereignty’. Parts II and III explore the protection of indigenous peoples afforded under the international law rules on human rights and investments respectively. Not only do the contributors to this book critically assess the current international legal framework, but they also suggest ways and methods to utilize such legal instruments towards the protection, promotion and fulfi lment of indigenous peoples’ rights, to contribute to the maintenance of peace and the pursuit of justice in international relations. Book excerpt: This book offers a comprehensive analysis of the legal issues around intangible cultural heritage (also known as traditional cultural expressions or folklore). It explores both institutional and substantive responses the law offers to the safeguarding of intangible heritage, relying heavily on critiques internal and external to the law. These external critiques primarily come from the disciplines of anthropology and heritage studies. Intangible cultural heritage is safeguarded on three different levels: international, regional, and national. At the international level, the foremost instrument is the specific UNESCO Convention for the Safeguarding of the Intangible Cultural Heritage (2003). At the regional level, initiatives are undertaken both in schemes of political and economic integration, a common thread being that intangible cultural heritage helps promote a common identity for the region, becoming thus a desirable aspect of the integration process. Domestically, responses range from strong constitutional forms of protection to rather weak policy initiatives aimed primarily at attracting foreign aid. Intangible heritage can also be safeguarded via substantive law, and, in this respect, the book looks at the potential and pitfalls of human rights law, intellectual property tools, and contractual approaches. It investigates how the law works and ought to work towards protecting communities, defined as those from where intangible cultural heritage stems, and to whom benefits of its exploitation must return. The book takes the critiques from anthropological and heritage studies into account in order to posit a re-shaped law, offering tools that can be valuable to both scholars and practitioners when understanding how to safeguard intangible heritage.

Cittadino’s harmonisation of these formally separated regimes serves at least two main purposes. First, it ensures respect for the human rights framework that protects indigenous rights whilst implementing the biodiversity regime. Second, harmonisation allows for the full operationalisation of the indigenous related provisions of the CBD framework that concern traditional knowledge, genetic resources, and protected areas. Federica Cittadino successfully demonstrates that the CBD may allow for the protection of indigenous rights in ways that are more advanced than under current human rights law.

Book excerpt: This book states that whilst academic research has long been grounded on the idea of western or scientific epistemologies, this often does not capture the uniqueness of Indigenous contexts, and particularly as it relates to the achievement of the United Nations Sustainable Development Goals (SDGs). The SDGs were announced in 2015, accompanied by 17 goals and 169 targets. These goals are the means through which Agenda 2030 for sustainable development is to be pursued and realised over the next 15 years, and the contributions of Indigenous peoples are essential to achieving these goals. Indigenous peoples can be found in practically every region of the world, living on ancestral homelands in major cities, rainforests, mountain regions, desert plains, the arctic, and small Pacific Islands. Their languages, knowledges, and values are rooted in the landscapes and natural resources within their territories. However, many Indigenous peoples are now minorities within their homelands and globally, and there is a dearth of research based on Indigenous epistemologies and methodologies. Furthermore, academic research on Indigenous peoples is typically based on western lenses. Thus, the paucity of Indigenous methodologies within mainstream research discourses present challenges for implementing practical research designs and interpretations that can address epistemological distinctiveness within Indigenous communities. There is therefore the need to articulate, as well as bring to the nexus of research aimed at fostering sustainable development, a decolonising perspective in research design and practice. This is what this book wants to achieve. The contributions critically reflect on Indigenous approaches to research design and implementation, towards achieving the sustainable development goals, as well as the associated challenges and opportunities. The contributions also advanced knowledge, theory, and practice of Indigenous methodologies for sustainable development.

Book excerpt: The recent austerity measures currently adopted in numerous European countries assume that a rise in public debt should automatically result in cuts to social programmes and the privatisation of “inefficiently” managed resources. This type of reasoning is being used to justify the destruction of social rights of citizens for the profit of the private sector, resulting in more limited access to the most fundamental resources such as water, nature, housing, culture, knowledge and information, mainly for the most vulnerable members of society. Such a view, informed solely by short-term growth and profit cycles, is endangering access to those resources not only for current generations but for future ones as well. This book is an attempt to go beyond liberal approaches to intergenerational and distributive justice. It emphasises the role of commons and communities of the commons, driven by the desire to defend and perpetuate those fundamental resources under the threat of expropriation by the state and the market. This book also offers policy makers and citizens, who wish to accept their political responsibility by being active and refusing corporate ideology, some best practices as well as methods and solutions for renewing the configurations of societal relationships through commons, thereby integrating the interests of future generations in the European Community’s decision-making processes and institutions.
