Le premier est relatif àl'ensemble des biens culturels. Son efficacité dépend de sa capacité à assurer des garanties réelles permettant de préserver cette catégorie de patrimoine culturel face aux dangers incessants la menaçant, tels que le trafic illicite et le conflit armé. Deux phases sont alors envisageables : une qui a trait à la prévention des menaces ; et une autre intervenant en cas d'échec de cette mission anticipative. Quant au second, il concerne une partie particulière des biens culturels se distinguant par son caractère exceptionnel, unique et irremplaçable. Il s'agit du patrimoine culturel commun de l'humanité qui bénéficie d'une protection spécifique. Ce second degré de protection est censé être plus élevé que le premier, voire même le plus élevé, car il est attribué aux biens très significatifs pour l'humanité. Se manifestant à travers deux régimes juridiques différents relatifs respectivement aux temps de paix et de conflit armé, cette protection reflète également deux degrés de portée divergente. Le premier étant satisfaisant tandis que le second est largement menacé par les exigences militaires.

L’analyse est conduite aussi à l’égard de la validité des solutions proposées, sur le plan du droit international privé et du droit uniforme, notamment en cas de revendication, de retour ou de restitution de biens culturels, ainsi que de la vérification de l’efficacité des réponses données par la jurisprudence et la doctrine concernant les règles nationales et internationales applicables.

The author has used the materials that emerged from the preparatory work for the Convention and has taken numerous examples from UNESCO’s records about the application of the Convention in conflicts over the last 40 years to illustrate this article-by-article commentary on the Convention itself, the Regulations for its Execution, and its Protocol. The author establishes parallels with other international legal instruments such as the 1977 Protocols Additional to the 1949 Geneva Conventions or the other UNESCO conventions relating to cultural heritage and puts forward ideas for a more general study of the protection of cultural property in the event of armed conflict and the legal and practical ways of achieving this. Des contraintes complémentaires trouvent leur source dans les droits de l’homme. d’autres titres de compétence, non territoriaux, ajoutent a la répartition des compétences des dimensions verticale et horizontale supplémentaires. Tous les États ont ainsi, en leur qualité de représentants de la communauté internationale, une responsabilité de protéger en la matière. Certains États, enfin, peuvent détenir des compétences a l’égard d’éléments du patrimoine culturel détermines qui se trouvent en dehors de leur territoire. Ainsi, des règles obligent les États a protéger le patrimoine culturel situe sur un territoire dont ils ont la maîtrise. D’autres surtout étendent leur juridiction, ou leur confèrent des obligations de protection a l’égard de certains éléments du patrimoine culturel situes en dehors de leurs frontières. D’autres encore leur permettent de revendiquer des biens culturels déterminés en raison de leur ancrage originel dans un groupe humain ou dans un espace particulier.
