Un principe d'indifférence à la vie personnelle a été reconnu dans l'ensemble des systèmes étudiés à partir desannées 1980. Malgré l'existence d'un cadre juridique protecteur à première vue, avec la reconnaissance d'un droit à la protection de la vie personnelle - qui limite et rationalise indubitablement les pouvoirs de direction de l'employeur - la protection connaît des tempéraments et des restrictions, afin d'atteindre un équilibre avec les intérêts légitimes et les droits de l'employeur. La vie personnelle se trouve donc limitée par les pouvoirs patronaux, aspect très largement sous-estimé. Tant le législateur que la pratique et la jurisprudence cherchent à définir les conditions de cet équilibre, que cette étude s'attache à décrire, en soulignant les obstacles techniques et en proposant des solutions pour les résoudre. Son objectif est de démontrer qu'il y a une tendance claire et nette à reconnaître à l'employeur un droit de plus en plus poussé à la restriction de la vie personnelle du salarié et que ceci risque de mettre en péril l'ensemble de la construction.

Book excerpt: Par les technologies de l'information et de la communication, les liens juridiques, sociaux, économiques et organisationnels entre le salarié et l'employeur se sont modifiés. L'usage des technologies a des effets sur de nombreux aspects oudimensions du travail qui sont intimement liés à la personne même du salarié. Avec l'article 8 CEDH comme fil conducteur et source principale des réflexions, la thèse réaffirme que le droit du travail et celui des droits de l'homme sont intimementliés et que l'article 8 CEDH s'applique aux relations entre travailleur et employeur. A l'aide d'une approche comparative, l'auteur analyse le droit à la vie privée du salarié en droit européen, en droit français et en droit suisse en faisant apparaître lesdifférences et les lacunes de l'un ou de l'autre droit. La première partie pose les bases du droit à la vie privée du salarié (vie familiale, domicile, correspondance, protection des données). Le difficile équilibre entre les intérêts de l'entreprise à sauvegarder sa sécurité et celui du travailleur à préserver son intimité fait l'objet de l'analyse. La deuxième partie traite de la mise en oeuvre de la protection de la vie privée du salarié en passant par l'élaboration des normes, les types de régulation etl'application qui en est faite par les autorités de surveillance nationales et par les autres acteurs internes ou externes à l'entreprise. La thèse démontre, sur la base d'une analyse comparée, qu' une meilleure protection du droit fondamental à la vie privée du salarié peut être valablement mise en oeuvre par le biais d'un règlement interne à l'entreprise, si possible discuté et négocié entre les partenaires sociaux. L'objectif est de protéger le droit à la vie privée de l'employé, non seulement en théorie, mais surtout en pratique.

The book argues that the regulation of care by the EU is crucial because it enables the development of a broad range of policies. It contributes to the sustainability of society and ultimately it enables individuals to flourish. Yet, to date, the EU approach to regulating the caring relationship remains piecemeal and lacks the underpinning of a cohesive strategy. Against this backdrop, this book argues that the EU can and must take leadership in this area by setting principles and standards in accordance with the values of the treaty, in particular gender equality, human dignity, solidarity and well-being. The book further makes a case for a stronger protection for carers, who should not only be protected against discrimination, but should also be supported, valued and put in a position to make choices and lead full lives. In order to achieve this, a proactive approach to rebalancing the relationship between paid and unpaid work is necessary. Ultimately, the book puts forward a series of legal and policy recommendations for a holistic approach to care in the EU.

While the Union had initially developed anti-discrimination norms that served only the commercial rationale of the common market, focusing on nationality (of a Member State) and gender as protected grounds, the Treaty of Amsterdam (1997) supplied five additional prohibited grounds of discrimination to the EU legislative palette, in line with a much broader egalitarian rationale. In 2000, two EU Equality Directives followed, one focusing on race and ethnic origin, the other covering the remaining four grounds introduced by the Treaty of Amsterdam, namely religion, sexual orientation, disabilities and age. Eighteen years after the adoption of the watershed Equality Directives, it seems timely to dedicate a book to their limits and prospects, to look at the progress made, and to revisit the rise of EU anti-discrimination law beyond gender. This volume sets out to capture the striking developments and shortcomings that have taken place in the interpretation of relevant EU secondary law. Firstly, the book unfolds an up-to-date systematic reappraisal of the five 'newer' grounds of discrimination, which have so far received mostly fragmented coverage. Secondly, and more generally, the volume captures how and to what extent the Equality Directives have enabled or, at times, prevented the Court of Justice of the European Union from developing even broader and more refined anti-discrimination jurisprudence. Thus, the book offers a glimpse into the past, present and – it is hoped – future of EU anti-discrimination law as, despite all the flaws in the Union's 'Garden of Earthly Delights', it offers one of the highest standards of protection in comparative anti-discrimination law.
