A cet égard, la Constitution apparaît comme la norme la plus à même d'assumer l'insigne tâche de poser les principes protecteurs de ce droit fondamental. L'examen des Constitutions écrites française et espagnole révèle pourtant que ce potentiel n'a pas été exploité en termes identiques par les pouvoirs constituants respectivement compétents. La lettre de la Constitution française de 1958 se borne, en effet, à régir les rapports institutionnels des principaux intervenants étatiques et ne fait référence qu'en termes sibyllins à la protection de la liberté individuelle. A l'inverse, la Constitution espagnole, parce qu'elle s'inscrit dans le mouvement démocratique qui a profondément bouleversé l'Europe du Sud dans les années 1970, répond à une acception maximaliste de la norme première et octroie un statut privilégié aux droits fondamentaux. Ce profond décalage va toutefois être très largement atténué par la juridiction constitutionnelle française. L'enrichissement de la charte jurisprudentielle par l'intégration des différentes composantes de la liberté individuelle, la mise en exergue de la fonction de l'autorité judiciaire, la promotion de la réserve de la loi et l'encadrement concomitant des habilitations législatives, la proclamation du droit au recours juridictionnel ainsi que l'implication du juge ordinaire dans la mise en œuvre de la jurisprudence constitutionnelle sont quelques uns des fleurons jurisprudentiels à mettre à l'actif du Conseil constitutionnel dans la garantie de ce droit fondamental. Par une démarche véritablement interventionniste, le juge français a ainsi très largement contribué à conférer à la protection constitutionnelle de la liberté individuelle un degré de sophistication proche de celui qui prévaut en Espagne. La péréquation entre les deux ordonnancements n'est cependant pas parfaite. Parmi les insuffisances françaises, il convient d'évoquer l'ambiguïté du statut constitutionnel du parquet dans ses rapports avec la liberté individuelle, l'absence de procédure d'habeas corpus comme le régime constitutionnel des situations de crise qui apparaît autrement moins performant qu'en Espagne. L'ordonnancement espagnol, pour sa part, n'est pas plus exempt de critiques. C'est ainsi que la rétention des étrangers en instance d'expulsion comme le régime des contrôles d'identité ou des titres de séjour ne disposent pas, sur le versant sud des Pyrénées, d'un cadre constitutionnel comparable à celui qui protège les personnes résidant sur le territoire français. En dépit de ces quelques points d'achoppement, force est de reconnaître néanmoins la convergence des ordonnancements considérés dans la protection constitutionnelle de la liberté individuelle."
