Además, se incluyen iniciativas de mejora elaboradas a partir del estudio de buenas prácticas en la respuesta italiana, país que cuenta con una mayor experiencia en su represión debido a la tradicional presencia de la mafia. Estas propuestas incluyen la adopción de medidas de tipo legal que refuercen las fórmulas de éxito en la lucha contra el crimen organizado, de tipo económico y empresarial que consideren la doble victimización de los empresarios, y de la que se deriva la idea de proteger tanto a las personas como a sus negocios, y de tipo social promoviendo la cultura de la legalidad mediante la resistencia empresarial en bloque y la implicación de la sociedad civil en el apoyo a quienes rechacen las exigencias extorsivas. La extorsión a empresas por parte del crimen organizado ha sido el objeto de investigación del proyecto europeo CEREU (Countering Extortion Racketeering in the EU) cofinanciado por la Comisión Europea del que la autora formó parte, y también el tema central de su tesis doctoral, dentro del programa de Derecho, Gobierno y Políticas Públicas de la Facultad de Derecho de la Universidad Autónoma de Madrid.

Cressey not only establishes this fact, but proceeds to explore it rigorously and with penetration. One need not agree with everything Cressey writes to conclude that no one, after the publication of "Theft of the Nation", can be knowledgeable about organized crime without having read this book.

Book excerpt: Armed conflicts are a major cause of forced displacement, but people displaced by conflict are often not recognized as refugees under the 1951 Convention Relating to the Status of Refugees. They are frequently considered as having fled from generalized violence rather than from persecution. This book determines the international meaning of the refugee definition in Article 1A(2) of the Convention as regards refugee protection claims related to situations of armed conflict in the country of origin. Although the human rights based interpretation of the refugee definition is widely accepted, the interpretation and application of the Convention as regards claims to refugee status that relate to armed conflict is often marred with difficulties. Moreover, contexts of armed conflict pose the question of whether and to what extent the refugee definition should be interpreted in light of international humanitarian law. This book identifies the potential and limits of this interpretative approach. Starting from the history of international refugee law, the book situates the 1951 Convention within the international legal framework for the protection of the individual in armed conflict. It examines the refugee definition in light of human rights, international humanitarian law, and international criminal law, focusing on the elements of the refugee definition that most benefit from this interpretative approach: persecution and the requirement that the refugee claimant's predicament must be causally linked to the race, religion, nationality, and/or membership of a particular social group or political opinion. It departs from existing models of endogenous growth in emphasizing obsolescence of old technologies induced by the accumulation of knowledge and the resulting process or industrial innovations. This has both positive and normative implications for growth. In positive terms, the prospect of a high level of research in the future can deter research today by threatening the fruits of that research with rapid obsolescence. In normative terms, obsolescence creates a negative externality from innovations, and hence a tendency for laissez-faire economies to generate too many innovations, i.e too much growth. This "business-stealing" effect is partly compensated by the fact that innovations tend to be too small under laissez-faire. The model possesses a unique balanced growth equilibrium in which the log of GNP follows a random walk with drift. The size of the drift is the average growth rate of the economy and it is endogenous to the model ; in particular it depends on the size and likelihood of innovations resulting from research and also on the degree of market power available to an innovator.

This work critically investigates the origins and foundations of the global anti-money laundering policy.
