La obra es de un género de investigación que aborda temas en lo sociológico, tecnológico y en lo jurídico penal.Ante toda esta revolución en la tecnología y en los mecanismos de identificación, se colige que se está ante un nuevo paradigma sociológico, que no solo posee ventajas, sino que también, conlleva riesgos, peligros y perjuicios con implicaciones jurídicas. En este sentido las personas se encuentran altamente vulnerables a los ataques a su identidad. Las nuevas tecnologías, la informática y muy especialmente Internet, han multiplicado las posibilidades de atentar contra los derechos de las personas, sobre todo contra los de más reciente reconocimiento, que suelen llamarse derechos personalísimos. Para el autor el tema de la identidad es un tema sumamente apasionante, es por ello que consideró desarrollar esta obra con la intencionalidad de realizar un aporte en materia doctrinal, proyectado como una investigación de tipo bibliográfica, de análisis legal y de los presupuestos históricos y teóricos relativos a los derechos de la identidad, al nombre y a la protección de los datos relativos a la identidad de las personas en la legislación guatemalteca, así también sobre las posturas iusfilosóficas sobre la identidad de las personas, las formas y los métodos de individuación y designación de estas, así como las modalidades de su registro y control que se han sucedido a través de la historia; los presupuestos teóricos generales de los derechos a la identidad, al nombre y a la protección de los datos relativos a la identidad; y las circunstancias históricas relativas al reconocimiento y la protección de los derechos a la identidad, al nombre y a la tutela jurídica de los datos relativos a la identidad.
