Book excerpt: This book explores various approaches around the world regarding price term control, and particularly discusses the effectiveness of two major paths: ex ante regulatory and ex post judicial intervention. Price control and its limits are issues that affect all liberal market economies, as well as more regulated markets. For the past several years, courts in many different countries have been confronted with the issue of whether, and to what extent, they should intervene regarding price-related terms in standard form contracts – especially in the area of consumer contracts. Open price clauses, flat remunerations, price adjustment clauses, clauses giving the seller/supplier the right to ask for additional payments, bundling or partitioning practices, etc.: a variety of price related terms are used to manipulate customers’ choices, often also by exploiting their behavioral biases. The result is an unfavorable contract that is later challenged in court. However, invalidating a given price term in standard forms e.g. of a banking or utilities contract only has an inter partes effect, which means that in thousands if not millions of similar contracts, the same clauses continue to be used. Effective procedural rules are often lacking. Therefore, pricing patterns that serve to hide rather than to reveal the real cost of goods and services require special attention on the part of regulators. The aim of this book is to determine the various approaches in the world regarding price term control, and particularly to discuss the efficiency of both paths, ex ante regulatory and ex post judicial intervention. Thanks to its broad comparative analysis, this book offers a thorough overview of the methods employed in several countries. It gathers twenty-eight contributions from national rapporteurs and one supra-national rapporteur (EU) to the 2018 IACL Congress held in Fukuoka. These are supplemented by a general report presented at the same IACL Congress, which includes a comparative analysis of the national and supranational reports. The national contributors hail from around the globe, including Africa (1), Asia (5), Europe (17), the European Union (1) and the Americas (5).

Concretamente, en este trabajo se abordan las peculiaridades que la aplicación del Texto Refundido de la Ley General para la Defensa de Consumidores y Usuarios a estos contratos plantea en la fase de formalización del contrato, la virtualidad que presentan las hojas de encargo profesional como mecanismo de protección de ambas partes del contrato, así como el régimen jurídico aplicable a éstas. Otro de los aspectos que se estudia es la posible presencia de cláusulas abusivas en los contratos que, para el desarrollo de su actividad profesional, celebran los abogados con consumidores, aspecto que adquiere relevancia puesto que se aprecia un cierto grado de estandarización de las prestaciones en algunos sectores de la Abogacía. Por último, se aborda la posible aplicación a este concreto sector profesional del régimen previsto en el artículo 147 del TRLGDCU que prevé, para su aplicación a los contratos de servicios en general, un sistema subjetivo con inversión de la carga de la prueba de la culpa. Loreto Carmen Mate Satué es Licenciada en Derecho por la Universidad de Zaragoza (2014) y Doctora en Derecho por la misma Universidad (2021). Sus líneas de investigación giran en torno a la Responsabilidad Civil y al Derecho de Consumo. Es miembro colaborador de distintos proyectos de investigación. Los resultados de sus investigaciones se han publicado como artículos en revistas especializadas españolas y extranjeras y como capítulos en obras colectivas, habiendo sido difundidos en distintos foros nacionales e internacionales. This need for "sustainable development" is and more by the responsible parties. Moreover, in the being recognised more search for solution strategies the realisation is gaining ground that tourism must be viewed as a worldwide phenomenon whose development must be co-ordinated in a co-operative effort spanning regions and continents. That the preservation of biological diversity also requires global co operation has been confirmed by over 170 countries which have already acceded to the "Convention on Biological Diversity". It is thus an important task to provide the foundations for joint action. Germany, one of the largest source countries of international tourism, must feel particularly obligated in this regard. The report published here is the result of a research project com missioned by the German Federal Agency for Nature Conservation. The study pursued and examined the thesis that the Convention on Biological Diversity be used as a central instrument for arriving at international principles and regulations for combining nature conservation and tourism which could lead to a sustainable development of tourism. To further the discussion, the authors brought the study to a logical conclusion by working out a proposal for a "tourism protocol" additional to the existing Convention on Biodiversity. Such a protocol additional to the Convention would entail the stipulation of internationally binding implementation and regulations for achieving sustainable tourism.
