Cet ouvrage présente de façon pratique la législation luxembourgeoise concernant la propriété intellectuelle, et plus principalement la législation concernant : les innovations techniques, protégées au moyen des brevets, les noms, logos et autres signes distinctifs, protégés par les marques, l'apparence des produits, et les dessins ou modèles, les logiciels informatiques, la comptabilité et la fiscalité relatives à ces droits. L'ouvrage s'adresse à la fois aux juristes et aux responsables de recherche et développement, mais également aux spécialistes du marketing et aux responsables informatiques. Il fournit des solutions pratiques, complétées par des exemples concrets, et envisage la propriété intellectuelle dans son ensemble. En effet, la propriété intellectuelle est un droit économique, et donc juridique, mais il s'agit également d'un outil commercial qui permet aux entrepreneurs et aux sociétés de se créer un monopole. Cet outil nécessite une prise en compte précoce, dans le cadre de tout projet, afin de pouvoir créer les droits mais également de les organiser et d'en tirer le meilleur profit, tant du point de vue commercial et juridique que du point de vue fiscal ou comptable. L'objet de ce Vademecum est donc de décrypter et d'analyser les différents droits, après avoir fait découvrir l'étendue de la propriété intellectuelle au moyen d'un questionnaire. Les bonnes pratiques à mettre en place par les entreprises ou les administrations sont ensuite présentées, afin de pouvoir les intégrer dans le processus décisionnel et dans la gestion de projets. Un chapitre complet est consacré aux situations pratiques, qu'il s'agisse du lancement d'un nouveau produit, de sa modification, mais également du développement d'un logiciel, d'une collaboration ou tout simplement d'un commerçant ou d'un prestataire de service. Chacune de ces situations est analysée et les différents droits disponibles et envisageables sont présentés. Afin de mettre en avant la valeur créée par ces actions, le Vademecum donne également des clés pour calculer la valeur des droits de propriété intellectuelle. Sont ensuite abordés les aspects fiscaux liés à la propriété intellectuelle, notamment dans le cadre de l'exonération de 80% des revenus nets en découlant. Pour permettre une compréhension totale de ces aspects, l'ouvrage aborde enfin les questions de comptabilité de la Propriété intellectuelle, et plus précisément comment la traiter sous l'angle comptable.

Book excerpt: In Socialism of Fools, Michele Battini focuses on the critical moment during the Enlightenment in which anti-Jewish stereotypes morphed into a sophisticated, modern social anti-Semitism. He recovers the potent anti-Jewish, anticapitalist propaganda that cemented the idea of a Jewish conspiracy in the European mind and connects it to the atrocities that characterized the Jewish experience in the nineteenth and twentieth centuries. Beginning in the eighteenth century, counter-Enlightenment intellectuals and intransigent Catholic writers singled out Jews for conspiring to exploit self-sustaining markets and the liberal state. These ideas spread among socialist and labor movements in the nineteenth century and intensified during the Long Depression of the 1870s. Anti-Jewish anticapitalism then migrated to the Habsburg Empire with the Christian Social Party; to Germany with the Anti-Semitic Leagues; to France with the nationalist movements; and to Italy, where Revolutionary Syndicalists made anti-Jewish anticapitalism the basis of an alliance with the nationalists. Exemplified best in the Protocols of the Elders of Zion, the infamous document that "leaked" Jewish plans to conquer the world, the Jewish-conspiracy myth inverts reality and creates a perverse relationship to historical and judicial truth. Isolating the intellectual roots of this phenomenon and its contemporary resonances, Battini shows us why, so many decades after the Holocaust, Jewish people continue to be a powerful political target.

A traditional argument to justify regulatory interventions is the promotion of public interests. Fixing markets that lack competition, balancing information asymmetries, internalising externalities, mitigating systemic risks, and protecting consumers from irrational behaviour are frequently invoked to complement the invisible hand of the market with the visible hand of the state.However, regulations can lead to unintended consequences, and serve the interests of powerful private interest groups rather than the public interest and social welfare. In addition, new insights from behavioural economics question the traditional regulatory approaches, most prominently in attitudes towards consumers. Furthermore, digitalisation and technological innovation in general present new challenges in terms of both the type of regulation and the regulatory process.Part I of this book discusses various theoretical approaches to the economic analysis of regulations, while Part II looks at specific applications of the law and economics of regulation.
