De este modo, nos encontramos con que muchos de nuestros comportamientos, cuya calificación jurídica estaba clara al realizarse en un entorno físico, ahora han pasado a realizarse dentro de un entorno inmaterial, como por ejemplo los diferentes sistemas de descarga de archivos. Esto supone que se genera incertidumbre sobre la licitud de determinados comportamientos que realiza una gran mayoría de los usuarios de los medios digitales, con todo lo que ello comporta. Esta situación se ha convertido en una de las motivaciones para la elaboración de la presente obra. Se ha pretendido dotar de una herramienta práctica, tanto a los profesionales del derecho, como a empresas cuya actividad se pueda ver afectada por este tipo de conductas, proporcionándole de esta forma orientación a todos los problemas que puedan ir presentándose.
