Ambas normas, que llevan a cabo una regulación análoga, pero no coincidente, tienen una importancia fundamental para nuestro Estado por varias razones. Por un lado, porque la ratificación por España las convierte en parte de nuestro Derecho interno. Por otro, porque teniendo en cuenta su peculiar objeto sirven para interpretar las normas relativas a los derechos fundamentales y las libertades que la Constitución reconoce. Esto ocasiona igualmente el sometimiento de nuestro sistema jurídico interno a los pronunciamientos jurisprudenciales supranacionales. Por todos esos motivos, la obra realiza un exhaustivo recorrido jurisprudencial, analizando la propiedad privada de manera integral, es decir, abordando también otras figuras de Derecho público sumamente relacionadas con ella, tales como la expropiación, el comiso penal y la imposición tributaria.
