Book excerpt: Despite broad international recognition of the criminalization of illicit enrichment, it has not been universally accepted as an anti-corruption measure. Instead, criminalization of illicit enrichment continues to generate extensive debate and controversy. Against this background, this volume aims to provide an analysis of how illicit enrichment works, and attempts to shed light on any contributions that it has made to the fight against corruption and the recovery of stolen assets. Rather than delving into the theoretical and academic debates around illicit enrichment, this study focuses primarily on the analysis of current practice, case law, and existing literature to offer a new perspective to the on-going discussions. More specifically, the volume addresses the legal framework upon which the concept of illicit enrichment rests, and the resulting policy implications of that legal framework. It also focuses on illicit enrichment as an anti-corruption mechanism, from its roots as a response to the problems inherent to prosecutions involving corruption, to an examination of elements and inchoate offenses relating to illicit enrichment under international conventions. It examines illicit enrichment jurisprudence in the global context. An extensive survey was carried out to determine the countries where the offense exists, what form it takes, how often it is used, and for countries where it doesn't, what other measures are used in its place. The authors neither recommend nor oppose the adoption of illicit enrichment provisions, but rather aim to assist jurisdictions considering such steps by highlighting key questions that might arise during implementation, including how the offense is defined and enforced domestically by States. Similarly, the authors do not endorse nor criticize any practice carried out by States in the implementation of the criminalization of illicit enrichment. Ultimately, it is also hoped that this study provides a basis for further discussion amongst policy makers and practitioners, and fuels upcoming discussions by the Conference of State parties of the UNCAC and its Working Groups

In The Declining Significance of Gender?, editors Francine Blau, Mary Brinton, and David Grusky bring together top gender scholars in sociology and economics to make sense of the recent changes in gender inequality, and to judge whether the optimistic or pessimistic view better depicts the prospects and bottlenecks that lie ahead. It examines the economic, organizational, political, and cultural forces that have changed the status of women and men in the labor market. The contributors examine the economic assumption that discrimination in hiring is economically inefficient and will be weeded out eventually by market competition. They explore the effect that family-family organizational policies have had in drawing women into the workplace and giving them even footing in the organizational hierarchy. Several chapters ask whether political interventions might reduce or increase gender inequality, and others discuss whether a social ethos favoring egalitarianism is working to overcome generations of discriminatory treatment against women. Although there is much rhetoric about the future of gender inequality, The Declining Significance of Gender? provides a sustained attempt to consider analytically the forces that are shaping the gender revolution. Its wide-ranging analysis of contemporary gender disparities will stimulate readers to think more deeply and in new ways about the extent to which gender remains a major fault line of inequality.

As the oldest organisation in the UN system, approaching its 100th anniversary in 2019, the ILO faces unprecedented strains and challenges. Since before the financial crisis, the global economy has tested the limits of a regulatory regime which was conceived in 1919. The organisation's founders only entrusted it with balancing social progress with the constraints of an interconnected open economy, but gambled almost entirely on tools of persuasion to ensure that this would happen. Whether that gamble is still capable of paying-off is the subject of this book, by a former ILO insider with an unrivalled knowledge of its work. The book forms part of a broader inquiry into the relevance of founding institutional principles to today's context, and strives to show that the bet made on persuasion may yet pay off. In part, the text argues that there may be little alternative anyway, showing that the pathways to more binding solutions are fraught with difficulty. Book excerpt: In the late 1950s, like tens of thousands of young men of his generation, Pierre Bourdieu, having recently passed the agrégation in philosophy, found himself immersed in the Algerian war. Motivated by an impulse that, as he himself says, ‘was civic rather than political’, nothing seemed more important to him than to understand the Algerian situation and provide the elements that would enable others to come to an informed judgement about it. In extremely tough conditions and along with a small group of students, Bourdieu undertook a series of studies across an Algeria that was tightly patrolled by the army, leading him to discover the shocking reality of the resettlement camps and to analyse the mechanisms of destruction of Algerian society of which they were emblematic. To achieve the objectives he had set himself, Bourdieu had to carry out a genuine intellectual conversion, acquiring an ethnographic understanding of Algerian society, learning sociological analysis at a breakneck pace and inventing new instruments - both theoretical and empirical - that would enable him to understand the relations of domination specific to colonialism. These new tools also enabled him to analyse the nature of the crisis that the war had both produced and manifested. This unique volume brings together the first texts written by Bourdieu in the midst of the Algerian conflict, as well as later writings and interviews in which he returns to the topic of Algeria and the decisive role it played in the development of his work.
