A pesar de que el tema de la sesión “Los Principios generales del Derecho y la reforma del Código Civil”, parecería circunscribir, por su origen, el interés de la presente obra al Proyecto de Código Civil argentino que está a estudio del Congreso Nacional, cabe destacar, sin embargo, que no es así, no solamente porque el texto del Proyecto argentino repite conceptos similares a los de la mayoría de los códigos civiles de los pueblos civilizados, sino también porque en realidad se trata de un texto de la ley positiva que involucra una cuestión directamente filosófica. Es verdad que el asunto puede exponerse en abstracto, dejando desarticuladas las diversas cuestiones independientes que suscita, y que la práctica anuda en un complexo. Pero nos ha parecido que se mejora el método de exposición partiendo, precisamente, de la práctica: es decir del texto de una ley que solo concreta y ejemplifica una serie de cuestiones universales, cuya conjugación en la práctica no es de carácter pragmático sino también fundamental. En otras palabras, con este método de exposición se muestra más de cerca el contacto entre la Filosofía y la vida en el mundo del Derecho, cosa que, a nuestro juicio, importa mucho para la instauración de la Filosofía jurídica en nuestro país, en que estamos empeñados". Book excerpt: What this book intends to do is to study three-dimensionalism (the distinction values-norms-facts) not in what could be called its historical dimension, but in its substantive aspect, as a “form” that, when applied to different legal themes, would add a “material content” to the three-dimensional theory. We can point out, as a study plan, the distinction between “three” perspectives: Those of the legal norm, of the legal order, and the legal relationship. Three-dimensionalism also appears in this work when one analyzes the “three” phases of the life of the law: The formation, the interpretation, and the application; and in the distinction between the “three” characteristics of the legal order: Fullness, coherence, and unity—the theory of legal validity, intended as legitimacy, as validity strictly speaking, or as effectiveness.
