Teniendo como eje central la participación de la infancia y la protección de sus derechos, revisa la adecuación del proceso judicial en atención a los derechos, necesidades e intereses de las víctimas menores de edad.

Available in PDF, EPUB and Kindle. Book excerpt: A finales de 2009, por la Fiscalía General del Estado, se emitió una Circular, 3/2009, sobre protección de menores víctimas y testigos. Tal Circular se enmarca dentro de un proceso general, tanto a nivel europeo como nacional, que se inicia a finales del siglo pasado y que tiene como propósito principal garantizar la necesaria protección de los menores de edad en el proceso judicial, sobre todo, penal, ya intervengan en la condición de víctima o de testigo. Así, podemos destacar la Decisión Marco 2001/220/JAI, de 15 de marzo, sobre estatuto y protección de las víctimas en el marco europeo. Dicha Decisión Marco responde a la pretensión de la Unión Europea de promover una política de protección de las víctimas dentro del Tratado de la Unión y del Tratado de Ámsterdam relativo a la creación de un espacio común de libertad, seguridad y justicia. La Decisión Marco presta singular atención a las víctimas consideradas especialmente vulnerables. Entre éstas destacan los menores. Así, se promueven diferentes medidas para evitar la segunda victimización. Ello se traduce en la exigencia de que el proceso no constituya para la víctima un nuevo sufrimiento innecesario, un nuevo plus de aflicción, lo que supone, entre otras medidas, procurar que se dé a las víctimas acogida correcta en un primer momento y que se creen en las dependencias policiales y judiciales lugares con condiciones adecuadas a la situación de la víctima y, especialmente, para la práctica de las pruebas. Pues bien, el libro analiza desde diferentes perspectivas jurídicas lo que para nuestro sistema jurídico suponen tanto la Decisión Marco como la posterior Circular en el ámbito de los procesos penales y civiles (sobre todo, en el ámbito del Derecho de familia), acudiendo a una revisión crítica que atiende a los diferentes intereses que se ponen en juego en los procesos; en especial, el interés del menor frente al derecho constitucional a un juicio justo del acusado.

Book excerpt: Despite legal and social advances in the past two decades, sexual and gender minorities continue to face widespread discrimination and violence in many countries. This discrimination and violence lead to exclusion, which adversely impacts their lives, as well as the communities and economies in which they live. A major barrier to addressing this stigma and sexual orientation and gender identity(SOGI)-based exclusion is the lack of SOGI-specific data. Robust, quantitative data on di‚fferential development experiences and outcomes of sexual and gender minorities--especially those in developing countries--is extremely thin. This paucity of data jeopardizes the achievement of the Sustainable Development Goals and countries' commitment to the principle of 'leaving no one behind' in the eff‚ort to end poverty and inequality. 'Equality of Opportunity for Sexual and Gender Minorities' assesses the unique challenges that sexual and gender minorities face in six important areas: (i) Criminalization and SOGI (ii) Access to education (iii) Access to the labor market (iv) Access to public services and social protection (v) Civil and political inclusion (vi) Protection from hate crimes. This report cov‚ers numerous policy recommendations to prevent and eliminate discriminatory practices in all of the areas covered. It also seeks to inflŽuence legislative changes and support research on institutions and regulations that can ultimately lead to poverty reduction and shared prosperity. At the same time, it acknowledges that the mere existence of inclusive laws and regulations does not ensure that sexual and gender minorities are free from discrimination--the enforcement of those laws is crucial. This publication, the first in a series of studies, will be expanded from the 16 countries included here to a wider set of countries for more in-depth quantitative analysis and to identify possible correlations with socioeconomic outcomes. It will seek to deepen knowledge, facilitate peer learning of good practices, and encourage reforms to increase the inclusion of sexual and gender minorities.
