Recientemente ha coordinado, en colaboración con el profesor Joan Picó i Junoy, la obra colectiva La ejecución civil: Problemas actuales (ed. Atelier, Barcelona, 2009).

Book excerpt: La Ley de Enjuiciamiento Civil española, de 7 de enero de 2000 (LEC), admitió de forma general la ejecución provisional de resoluciones judiciales que contengan pronunciamientos de condena a favor de una de las partes, y sin necesidad de prestar caución para instar su despacho, excluyendo de forma excepcional y expresamente del ámbito objetivo de esta institución determinadas resoluciones. Esta opción de política legislativa significó un impulso de la ejecución provisional y una decidida confianza por la administración de justicia de primera instancia sin precedentes en el ordenamiento procesal civil español, y ha sido considerada como una de las principales novedades introducidas por la LEC. Para ello, el legislador partió de la base de que la ejecución de las resoluciones judiciales no depende de su firmeza, y no se opone a la Constitución la regulación legal de un régimen de ejecución provisional. Así, se implementa un sistema de ejecución provisional –entendida como una modalidad de la ejecución ordinaria o definitiva que confiere efectividad a las resoluciones judiciales no firmes que contienen pronunciamientos de condena y que han sido impugnadas, cuyos efectos se encuentran supeditados al resultado del recurso interpuesto frente a ella– que se caracteriza por realizar una regulación completa y unitaria de la institución, esto es, fijando una misma normativa aplicable tanto a la ejecución provisional de resoluciones de primera como de resoluciones de segunda instancia, que se encarga de establecer no sólo los requisitos y presupuestos para que opere este instituto, sino regulando un específico régimen de oposición como único mecanismo de defensa del ejecutado provisional frente a la ejecución previamente despachada y regulando los efectos de la confirmación y, especialmente, de la revocación del pronunciamiento provisionalmente ejecutado...

Set in the Havana of the 1830s, the novel introduces us to Cecilia, a beautiful light-skinned mulatta, who is being pursued by the son of a Spanish slave trader, named Leonardo. Unbeknownst to the two, they are the children of the same father. Eventually Cecilia gives in to Leonardo's advances; she becomes pregnant and gives birth to a baby girl. When Leonardo, who gets bored with Cecilia after a while, agrees to marry a white upper class woman, Cecilia vows revenge. A mulatto friend and suitor of hers kills Leonardo, and Cecilia is thrown into prison as an accessory to the crime. For the contemporary reader Helen Lane's masterful translation of Cecilia Valdés opens a new window into the intricate problems of race relations in Cuba and the Caribbean. There are the elite social circles of European and New World Whites, the rich culture of the free people of color, the class to which Cecilia herself belonged, and then the slaves, divided among themselves between those who were born in Africa and those who were born in the New World, and those who worked on the sugar plantation and those who worked in the households of the rich people in Havana. Cecilia Valdés thus presents a vast portrait of sexual, social, and racial oppression, and the lived experience of Spanish colonialism in Cuba.
