U. n. 5 dell’8 gennaio 2014), in vigore dal 7 febbraio 2014, analizza tutta L’EVOLUZIONE NORMATIVA succedutasi per affermare la totale equiparazione tra figli legittimi e naturali. Sono stati aboliti i pregressi distinti stati di filiazione, nonché la categoria dei figli non riconoscibili, con l’affermazione dell’unicità dello stato giuridico di figlio. Inoltre è stata introdotta una disciplina incentrata sulla figura del figlio, con il superamento del tradizionale concetto di potestà in favore della RESPONSABILITÀ GENITORIALE. Sono state dettate nuove norme in tema di riconoscimento, azioni di stato, PROVA DELLA FILIAZIONE, inserimento del figlio nato fuori del matrimonio nella famiglia del genitore, specificazione della nozione di abbandono, diritto internazionale privato, in parte recependo gli orientamenti nel tempo maturati nella giurisprudenza costituzionale e di legittimità. Sono state specificamente regolamentate le forme con le quali gli ascendenti possono far valere il loro diritto a mantenere rapporti significativi con i nipoti minorenni e le modalità con cui deve essere realizzato L’ASCOLTO DEL MINORE, privilegiando la spontaneità e genuinità delle relative dichiarazioni. È stato ribadito il fondamentale diritto del figlio di vivere e crescere nella propria famiglia di origine e sono state introdotte importanti modifiche in materia di successione mortis causa. - Dai filii iusti o legitimi ed i figli naturales o vulgo concepti alla equiparazione della filiazione legittima e naturale. Le decisioni della Corte europea dei diritti dell’uomo- La legge 10 dicembre 2012, n. 219 recante le “Disposizioni in materia di riconoscimento dei figli naturali”. L’unificazione dello stato di figlio- Il percorso di parificazione tra famiglia legittima e famiglia naturale- Famiglia, famiglie. Book excerpt: This book centres on the ways in which the concept of imperativeness has found expression in private international law (PIL) and discusses “imperative norms”, and “imperativeness” as their intrinsic quality, examining the rules or principles that protect fundamental interests and/or the values of a state so as to require their application at any cost and without exceptions. Discussing imperative norms in PIL means referring to international public policy and overriding mandatory rules: in this book the origins, content, scope and effects of both these forms of imperativeness are analyzed in depth. This is a subject deserving further study, considering that very divergent opinions are still emerging within academia and case law regarding the differences between international public policy and overriding mandatory rules as well as with regard to their way of functioning. By using an approach mainly based on an analysis of the case law of the CJEU and of the courts of the various European countries, the book delves into the origin of imperativeness since Roman law, explains how imperative norms have evolved in the different conceptions of private international law, and clarifies the foundation of the differences between international public policy and overriding mandatory rules and how these concepts are used in EU Regulations on PIL (and in the practice related to these sources of law). Finally, the work discusses the influence of EU and public international law sources on the concept of imperativeness within the legal systems of European countries and whether a minimum content of imperativeness – mainly aimed at ensuring the protection of fundamental human rights in transnational relationships – between these countries has emerged. The book will prove an essential tool for academics with an interest in the analysis of these general concepts and practitioners having to deal with the functioning of imperative norms in litigation cases and in the drafting of international contracts. Book excerpt: The observation that mater semper certa est remains accurate under most legal systems in the world. Maternity is defined as the personal status (filiation) of a woman who gave birth to a child. It is typically complemented by the fatherhood of the man from whom the child biologically originates (often quem nuptiae demonstrant). However, in some states, a kind of competitive way of acquiring the legal status of mother and father (or “homosexual parents A and B”) has been introduced via concluding a contract with a surrogate mother. Usually with a woman coming from poorer societies and with the assistance of professional intermediaries and organizers. The postulates to change substantive family law, or at least to recognize the effects of foreign law and procedures (a kind of “procreative tourism”), appear nowadays also in states generally prohibiting surrogate motherhood. The issues discussed in this volume concern both national law and international court cases. Recent examples include the opinion of the European Court of Human Rights of 10 April 2019 initiated by the French Cour de cassation, the judgement of the German Bundesgerichtshofof 20 March 2019, and dilemmas of Polish administrative courts. Focusing on the international perspective, the present volume as well as an accompanying book in Polish are the results of the international cooperation of over 30 experts from both member states and observer states of the Council of Europe. The monograph is structured “from the general to the detail” and includes a comprehensive view as well: from the issues of philosophy and sociology of law, to human rights standards of national constitutions and international agreements, to principles of ordre public of forum and their protection with measures of private, public, and penal law. This allows readers, including legislators and judges, the better understanding of the fundamental legal problems that surrogate motherhood brings, both in states where law creates them in a narrower or wider extent, and in other countries of the world, to which these problems can be imported with the movement of people and with de lege lata and de lege ferenda postulates.

The present book is a contribution to the clarification of operating procedures used by the current legislation of the European Union for the protection of the right to family unity, and in particular the right to family reunification of individuals. From a formal point of view the right to family reunification, enjoys international and national protection. This book examines the protection of family life and family reunification within the framework of international conventions on human rights, family reunification and the protection of family life in the area of justice, the rights of family members of European citizens in the EU legislation and the case law; the rules set by the Directives 2004/38/EC and 2003/86/EC, the relationship between EU legislation on family reunification and the respect of national rules governing the entry and residence of migrants. An important part of this work is dedicated to the right of family reunification in the national law, namely to protect the family unit in Italy in accordance with the Consolidated immigration no. 296/98.
