Book excerpt: La declaración por los Tribunales de la nulidad de actuaciones en el proceso administrativo es, si cabe, todavía más importante que en el proceso civil y penal, toda vez que los efectos son, con frecuencia, mucho más radicales y perentorios. En efecto, en los procesos civiles y penales la declaración de la nulidad de actuaciones tiene casi siempre como único efecto la reposición de los autos en el momento en que se cometió la falta o defecto procesal, continuando luego el proceso por sus cauces normales hasta que se dicta sentencia, mientras que en lo contencioso administrativo la nulidad de lo actuado muchas veces tiene como consecuencia ineludible la nulidad de todo el proceso. Verdad es que en algunos casos, la nulidad de actuaciones en el proceso penal puede tener como resultado la absolución y puesta en libertad del reo, por ejemplo cuando todas las pruebas de cargo han sido obtenidas de una manera ilegal, empero ello no suele ser frecuente, pues casi siempre ha habido alguna o algunas correctamente obtenidas en las que el Tribunal puede fundamentar su fallo. En los procesos administrativos, la combinación de la nulidad de actuaciones con el instituto jurídico de la prescripción, puede adquirir una capital importancia y unas dimensiones extraordinarias. Esta obra es más que un simple tratado sobre la Nulidad de actuaciones. En efecto, en la numerosa jurisprudencia del Tribunal Supremo en ella recogida, podrán los profesionales de Derecho encontrar abundantes indicaciones sobre muchos errores que se deben evitar, no sólo concernientes a las notificaciones, sino también a otros trámites del procedimiento y proceso administrativos, como pueden ser la manera de proponer la demanda, la propuesta de prueba y su celebración, etc...

Book excerpt: Las casos judiciales mediáticos son fáciles de identificar con la Política y la corrupción del poder, lo que en buena medida radica en la perenne crítica a la elección de los miembros de tribunales superiores, y también del Tribunal Constitucional, eventual interviniente ulterior. Pero la inmensa mayoría de juicios, cotidiana y habitual, se lleva a cabo en órganos judiciales ajenos a ese interés partidista tan publicitado, de mano de un personal jurisdiccional que, a pesar de la creciente llamada al respeto del Estado de Derecho que desde la representación del colectivo judicial viene reiterándose en los últimos años, es a no dudarlo el protagonista último y principal del incumplimiento sistemático y generalizado del orden procesal establecido por el legislador ordinario. Muy lamentablemente, la explicación de tan paradójica y vergonzante situación se asienta, por lo general, en dos grupos de causas, la ignorancia del siempre se ha hecho así y la mera comodidad. A fin de sostener estas afirmaciones se han repasado diversas instituciones jurídicas manipuladas en el día a día judicial por marginar las normas en vigor y el recto entendimiento de principios jurídicos y valores constitucionales, tomando como eje de estudio la nulidad procesal enlazada con derechos y garantías del justiciable tan representativos como la prueba y la defensa, singularmente el peritaje en el proceso penal, el ofrecimiento de acciones penales y civiles a las presuntas víctimas y ofendidos, el juicio en ausencia del acusado y la expulsión de personas de nacionalidad extranjera antes o durante su enjuiciamiento criminal, añadiendo a lo anterior ejemplos específicos de una técnica de evitación procesal que agrupa cuestiones vinculadas con la nulidad y el derecho de defensa y la relación conflictiva entre jueces de instrucción y jueces de lo penal: la necesidad de conocimiento por parte del inculpado de los hechos criminosos que durante la instrucción de la causa se imputan, primero, y se acusan, después. El autor es licenciado y doctor en Derecho por la Universitat de Barcelona, donde ha sido docente en el Departamento de Derecho administrativo y Derecho procesal, así como profesor invitado en otras Universidades de Cataluña. En la actualidad es profesor del Instituto Superior de Derecho y Economía e imparte clases de su especialidad en la Facultad de Psicología de la Universitat Autònoma de Barcelona; ha publicado medio centenar de trabajos en revistas jurídicas especializadas, así como una docena de monografías y ocho obras en colaboración. Asesor letrado del equipo jurídico de Amnistia Internacional-Catalunya desde 1994 a 2000, integró la Comisión de Cultura del Colegio de Abogados de Barcelona hasta noviembre de 2003 siendo miembro del Instituto de Psicología, Sociología y Medicina Jurídicas. Desde febrero de 2000 ejerce la jurisdicción: por concurso en Barcelona, por oposición desde 2004, decano en los partidos judiciales de Vilafranca del Penedès y Esplugues de Llobregat y, desde 2011, magistrado de lo Penal en Barcelona. Está casado y es padre de cuatro hijos.
