The study provides a comparison of the sentencing practices of each country, focusing on three dimensions related to the sanction practices: the custodial sanctions, the alternative sanctions, and the extension of the judicial thinking into relative fields such as school, training, and social policies. With clear and thoroughly developed research methods, this analysis illustrates that changes in juvenile justice policies are not specifically the result of differences in crime rates or the evolution of deviant youth behavior, but rather the effect of complex interactions with a variety of social, economical, cultural, and political factors.

This book seeks to understand regime resilience and breakdown by analysing the public meaning of youth, as well as the physical mobilization of young people. Mobilization carried by young people is a key component in understanding the stabilisation of the authoritarian regime structures in contemporary Russia, but the Russian experience makes only sense if placed in its broader historical context.Three comparative cases, the breakdown of the authoritarian Soviet Union, the breakdown of the democratic Weimar Republic, and the crisis of the democratic regime in France around 1968 highlight how regimes which lacked popular support have compensated for their insufficient legitimacy by trying to mobilize youth symbolically and politically. This book illustrates the symbolic significance of youth and its role in regime crisis by analysing a new data set of newspaper articles with a new method of discourse analysis. The combination of qualitative interpretation and quantitative network analysis enables a deeper and more systematic understanding of discursive structures about youth. Through this methodological innovation the book contributes to the way we define the categories of youth, generation, and crisis. It makes the case that our conceptualisation should reflect the way terms are being used - usages that can be captured in a systematic way with new methods of discourse analysis. The last few decades have witnessed major debates over youth justice policies. Juvenile and youth justice legislation has been reviewed in a number of countries. Despite the fact that new perspectives, such as restorative justice, have emerged, the debates have largely focused on issues that bring us back to the inception of juvenile justice: namely whether youth justice ought to be more akin to punitive adult criminal justice, or more sensitive to the welfare of youths. This issue has been at the core of policy choices that have given juvenile justice its orientations since the beginning of the twentieth century. It also gave shape to the evolution that paved the way for the creation of juvenile courts in the nineteenth century. Understanding those early debates is essential if we are to understand current debates, and place them into perspective. Based on primary archival research, this comprehensive study begins by presenting the roots, birth and evolution of juvenile justice, from the nineteenth century up to the beginning of the twenty-first. The second part deals with nineteenth century responses to juvenile delinquency in England and Canada, while the third focuses on the welfare orientation that characterized juvenile courts in the first half of the twentieth century in Switzerland, the Netherlands, Germany and Belgium. Finally, the fourth part focuses on the perspective of the youths and their families in Belgium, France and Canada.

In doing so, it delves into the paradox of an institution exerting control over youths while at the same time promoting their autonomy and responsibility. The study sheds light on the specific logics of power, control, and inequality produced by such institutional settings. The book’s analysis is based on an ethnographic study of ‘Assisted Freedom’ (Liberdade Assistida) – a form of probation – in the Brazilian cities of Rio de Janeiro and Belo Horizonte. This particular context – which is characterized by endemic violent crime, on the one hand, and a highly protective juvenile justice system, on the other – sheds productive light on the contradictions of juvenile justice systems and other public policies based on the values of citizenship, autonomy, and responsibilization. The analysis takes the form of an inverted zoom structure: it begins by looking at cognitive and interactional processes at the level of interpersonal relationships between youths and professionals, and then works its way up to examine ties outside the institution itself, with schools, the labour market, and juvenile courts. Written in a clear and direct style, this book will appeal to students and scholars in criminology, sociology, cultural studies, and social theory and those interested in learning about non-custodial measures and the regulation of juvenile delinquency.

Moving away from idealised accounts of judicially supervised investigations, it provides a better understanding of the ways in which an inquisitorially rooted criminal process operates in practice and the factors that influence and constrain its development and functioning. The structure and operation of French criminal justice is set within a broad range of contexts of political, occupational and legal cultures from the French Republican tradition of state-centred models of authority, across the growing influence of the ECHR, to the local conditions which determine the ways in which individual discretion is exercised. The French model of investigative supervision and accountability is contrasted with more adversarial procedures and in particular, the different ways in which the reliability of evidence is guaranteed and the interests of the accused protected. Systematic observation of the daily working practices of police, gendarmes, prosecutors and juges dinstruction across a number of sites and time periods, provides a unique and detailed account of the ways in which the French criminal process operates in practice.
