Book excerpt: La notion de l’accès aux soins en droit se distingue du droit d’accès aux soins et permets de dire les écarts entre les régimes juridiques existants et l’accès aux soins comme fait social. L’intérêt d’une étude concernant la notion d’accès aux soins est de penser son émergence dans l’histoire du droit et sa matérialité en droit positif concernant vis-à-vis des droits libertés, de l’acte et de la relation médicale. L’émergence et les tensions internes concernent les questions de droit relatives aux droits de créance, à l’égalité d’accès aux soins en fonction et la problématique de l’égalité et de l’acception ou non des personnes qui peuvent être établies dans la justice distributive en la matière vis-à-vis des biens rares, de la citoyenneté, de l’égalité géographique etc. Ces distinctions ne peuvent se comprendre, d’une part, que sous couvert de l’étude du paniers de biens et de service de santé existant, et, d’autre part, dans les conceptions du contrat social et de la justice sociale en la matière, vis-à-vis, de la notion de service public (universel) de la santé et des périmètres de la protection sociale issue de la philosophie politique. L’étude de l’émergence principielle et technique, est à souligner pour ne pas verser dans une conception relativiste de l’accès aux soins qui demeure, à l’instar de ce qui touche à la médecine, toujours, une question éthique et tragique. Dans le droit français, c’est sous couvert de la République sociale et de la République libérale que doit être appréciée la République des soins en l’heureuse synthèse de l’éthicité de notre État de droit, vis-à-vis des principes républicain, de liberté (tension entre liberté et autonomie), d’égalité (formelle et matérielle) et de la fraternité

The various contributions are accompanied by strong recommendations that challenge the holders of issues for their application in a process of co-construction for an active citizenship of transformation. It is a document of advocacy/indictment and lobbying in favor of the development, protection and improvement of the social conditions of the elderly and persons with disabilities in Africa in terms of health, food, housing, environment, social protection, income maintenance, employment and education, given their increasing numbers in relative and absolute terms. The issue of socially vulnerable people is thus brought to the forefront of important, if not permanent, political-social and scientific concerns. It is the subject of recurrent investigations and reflections within the special mechanism of the African Union, the Working Group on Elderly Persons and Persons with Disabilities of the African Commission on Human and Peoples' Rights. The initial assignment is to build legal, psychological, socio-anthropological and political vehicles in order to initiate positive change and sustainable protection of VHPs, as well as customary protocols for their valorization in African cultures and traditions.

Il a comme fonction la limitation des obligations substantielles des États lors de la survenance d’un fait-condition – la situation de nécessité – afin d’éviter que l’application du droit ne génère un coût social excessif. Sa réalisation requiert toujours une pondération des intérêts en conflit. Seulement lorsqu’un coût social excessif ne peut être évité, l’état de nécessité intervient dans le cadre des obligations secondaires de la responsabilité internationale, en tant que circonstance atténuante. After much hesitation, the International Law Commission codified the state of necessity as a circumstance precluding wrongfulness in the field of State responsibility. This study aims to demonstrate that it is a much wider mechanism, essential to international law and strictly connected to its own characteristics. It performs the function of limiting the substantial obligations of States in case of the realization of a fact condition – a situation of necessity – in order to avert an excessive social cost, born out of law implementation. It always works through a balance of conflicting interests. Only when a social cost cannot be avoided, the state of necessity, under the features of a mitigating circumstance, enters the field of secondary obligations relating to international responsibility.
